597) and acknowledged the within Deed and the Lands and premisses therein mentioned to be the Right and Estate of the within Henry Gassaway the Day and Year af.d Recorded July 11.th 1755 Geo Steuart 6 This Indenture made the twenty sixth day of June in the Year of Our Lord One thousand Seven hundred and Fifty five Between Thomas Brooke of Prince Georges County of the one part and Eleanor Carroll Executrix of Daniel Carroll late of the County af.d Deceased of the other part Witnesseth that the Said Thomas Brooke for and in Consideration of the Sum of Fifty pounds Current Money to him in hand paid the Receipt whereof the Said Thomas Brooke doth hereby Acknowledge Hath Given Granted Bargained Sold Alliened Enfeoffed confirmed and made over and by these presents doth for himself and his Heirs Give grant Bargain Sell Allien Enfeof Confirm and Make over unto the said Eleanor Carroll his Heirs and assigns for Ever all that Moiety or part of a Tract of Land Lying in Frederick County containing three hundred Acres called Four Gallons and a half of Rum be the Same More or less together with all and singular the Improvements thereon or in any manner appurtaining To have and to hold the Land and Premisses with the appurtenances unto her the said Eleanor Carroll her heirs or assigns and to no other use intent or purpose And the said Thomas Brooke doth for himself and his Heirs Covenant promise Grant and agree to and with the Said Eleanor Carroll her heirs and assigns and the Said Thomas Brooke and his Heirs the af.d Tract or parcell of Land and premisses with the Appurtenances unto her the said Eleanor Carroll her heirs and assigns shall and will for Ever hereafter defend Provided Nevertheless and it is the true Intent and meaning of these presents and the partys hereunto that if the Said Thomas Brooke his heirs Executors and Administrators Shall well and truly pay or Cause to be paid unto the said Eleanor Carroll her Certain Attorney Executors Administrators or assigns the full and Just Sum of Fifty pounds Currency at or upon the first Day of August Next together with Legal Interest thereon from the Date hereof Then this Indenture and Claim Matter and thing therein Contained Shall be from henceforth utterly Void and of None Effect otherwise to Stand remain abide and be in full Power Strength and Virtue in Law anything contained to the Contrary notwithstanding In Witness Whereof the party first above mentioned hath hereunto Set his hand and Seal the Day and Year first above Written Signed Sealed and Delivered Tho.s Brooke Seal In the Presence of J Hepburne Benj.a Hall Jun.r W Barnes Jun.r (At) |
