519 said Deed that if the said Lingan Wilson or any person in his behalf Should well and truly without Fraud or Covin pay or satisfie unto me the said John Eversfield my Certain Attorney Heirs Executors or Administrators at any time from the Date of the said Deed to the Twenty ninth Day of September One Thousand Seven hundred and fifty Six the af.d one hundred and Sixty one pounds Nine shillings Sterling Money of Great Britain with legal Interest for the same until payment thereof be made that then the above Recited Deed of Bargain and Sale and Every Clause therein Should be Absolutely Void and of None Effect and further to me Provided also that the Possession of Enjoyment of the Premisses Should be in the said Lingan Wilson his Heirs and Assigns until default of payment should be made within the time Limitted af.d And whereas the Said Lingan Wilson According to the Proviso contained in the above Recited Mortgage Deed hath well and truly paid unto my Resident Attorney in said Province The Reverend M.r John Eversfield my Father for my Use and Behoof the sum of one hundred and Sixty one pounds Nine shillings sterling with legal Interest until the twenty ninth day of August One Thousand Seven hundred and fifty three as Specified as part Consideration for the af.d Tract of Land called Kinsale containing two hundred and fifty Acres more or less and s.d part of a Tract called Beanes Landing thereto Adjoyning containing twenty four Acres More or less in the Recited Mortgage above made over and conveyed to my said Father the Reverend John Eversfield his Heirs and Assigns for Ever by an Absolute Deed of Bargain and Sale from the said Lingan Wilson bearing Date August twenty ninth One Thousand Seven hundred and fifty three and Enrolld among the Records of said County Reference thereunto had may further appear the Receipt of which payment of One hundred and Sixty one pounds nine Shillings Sterl with legal Interest To the Time aforesaid allowance made for New Styl.s in Manner Specified in the absolute Deed of Bargain and sale [illegible] John Eversfield my Resident Attorney in said Province by the said Lingan Wilson I do hereby Acknowledge and myself therewith fully Satisfied contented and paid and thereof and Every part thereof do fully and thoroughly acquit Release and Discharge the said Lingan Wilson his Heirs Executors and Administrators for Ever by these presents And for as much as the Said Lingan Wilson hath the proverty of the remaining part of Brookhill after satisfaction made for the Deficiency in Said Land conveyed to M.r James Russell as af.d in the af.d Mortgage as the Reverend John Eversfield my Father hath the Property in the af.d Land of Kinsale and part of Beanes's Landing thereto Adjoining in the same with an Acquittance (only) |
