404) the same Deed within Written to be their Act and Deed and the same Mary being first by Us privately examined out of the sight and hearing of her said Husband declared and said that she made over the same Acknowledgm.t Voluntarily and freely and without being Compelled or induced thereto by fear of his Displeasure in Testimony whereof We have hereunto set our hands the Day and Year above Written 7 sides Jas Brown Recorded Sept.r 21.st 1753 Jn Seegar Ex.d This Indenture made the Tenth day of August in the Year of our Lord One Thousand Seven hundred and fifty three Between Nicholas Maccubbin of Ann Arundel County Merchant and Mary his Wife of the one part and James Tilghman of Talbot County Attorney at Law of the other part Witnesseth That the said Nicholas and Mary for and in Consideration of the Sum of five Shillings Current Money of Maryland to them in hand paid by the said James Tilghman at the Sealing and Delivery of these Presents ^the Receipt whereof^ they do hereby Acknowledge and of every part and Parcel thereof do Acquit and Discharge the said James Tilghman his Heirs Executors and Administrators for ever and by these Presents have granted bargained and Sold released and Confirmed and by these Presents do grant bargain and sell release and confirm unto the said James Tilghman his Executors Administrators and Assigns six hundred and fifty five Acres of Plantable Land lying in Queen Annes County being the residue of those Lands lying in the same County called Lloyds Meadows Resurveyed and Lloyds Meadows Addition late in the Tenure and Occupation of Alice Lloyd late of Queen Annes County afsd deceased which was unconveyed and undevised by the said Alice Lloyd to Philemon Charles Blake of the same County Gentleman and one Messuage thereon being together with all Trees Woods Underwoods Common Commons of Pasture Profits Commodities Advantages Emoluments and Hereditaments whatsoever to the Premisses belonging or in any wise appertaining or in or upon the same happening growing or arising and also the Reversion and Reversions Remainder and Remainders thereof To have and to hold all & singular the Premisses with the Appurtenances and every part of them unto the said James Tilghman his Executors Administrators and Assigns from the day before the date hereof for and during the Term of one whole Year from thence next ensuing and fully to be Compleated and ended, yielding and paying therefore to the said Nicholas and Mary or their Assigns the Yearly Rent of one Pepper Corn at the Feast of Saint Michael the Arch Angel only if the same be Demanded to the Intent that by Virtue of these Presents and of the Statute for Transferring Uses into Possession the said James Tilghman may be in Actual Possession of the (Premisses) |
