403) same Writ the same James Roseberry and Mary his Wife did appear and did Vouch to Warranty thereof Richard Goldsmith who being present in Court in his Proper Person Warranted the Lands and Tenements afsd with the Appurtenances unto the same James Butler and afterwards departed in Contempt of the Court and made default whereby a good perfect and Common Recovery of the said Land Tenements & Appurtenances with single Voucher over according to the form and course of Common Recoverys in such Cases Used was in due form of Law suffered and executed Now this Indenture Witnesseth that the same James Butler & James Roseberry and Mary his Wife and each of them their and each of their Heirs Exors and Administrators and Assigns do hereby Covenant Promise Grant Declare and Agree to and with each other their and each of their heirs and Executors Administrators and Assignes do hereby Covenant Promise grant declare and Agree to and with each other their and each of their Heirs Executors Administrators and Assignes by these Presents that the true Intent and meaning of the same Recovery and of the Partys thereunto and to these Presents was and is and it is by these Presents and the Partys thereunto declared that the said Common Recovery and all effects thereof shall be and enure and shall be Construed and taken to be and enure to the only Uses Intents and Purposes hereafter mentioned that is to say all those two Tracts of Land abovementioned described as afsd with the Appurtenances shall be and enure and shall be Deemed Adjudged and taken and is meant & intended and by all the said Parties to these Presents it is hereby declared to be and enure to and for the only Use of the same James Roseberry Mary his Wife their Heirs and Assigns for ever and that they the same James Roseberry and Mary his Wife shall stand and be Seized of all and singular the Parcels of Land above mentioned described as above and every part thereof with the Appurtenances to and for the their Heirs and Assignes for ever and to and for no other Use Intent or Purpose whatsoever In Witness whereof the Parties afsd to these Presents have hereunto Interchangeably set their hands and seals the Day and Year first above Written James Butler seal Sealed and Delivered in Presence of James Roseberry seal R.d Tilghman Ja.s Brown her Alex.r Williamson jun Jn Seegar Mary M Roseberry seal mark On the back of the aforegoing Deed was thus Endorsed Viz.t Queen Annes County fs.t Be it Remembered that on the tenth day of Sept.r Annoq Dom One Thousand and seven hundred and fifty three James Butler James Roseberry and Mary his Wife Partys to the within Written Deed Personally Came and Appeared before Us the Under written two of the Right Honourable the Lord Proprieters his Justices for the County afsd and severally Acknowledged (the) |
