402) Use of the same James Butler and Sarah his Wife their heirs and Assigns for ever and that the same James Butler and Sarah his Wife shall stand and be Seized of all and singular the Parcel of Land above mentioned and described with the Appurtenances to and for the only proper Use and Behoof of the same James Butler and Sarah his Wife their heirs and Assigns for ever and to and for no other Use Intent or Purpose whatsoever In Witness whereof the Parties afsd to these Presents have hereunto Interchangeably set their hands and Seals the Day and Year first above Written Sealed & Delivered in Presence of James Roseberry seal R.d Tilghman Jas Brown James Butler seal Alex.r Williamson jun Jn Teegar her Sarah X Butler seal mark On the Back of the aforegoing Deed was thus Endorsed Viz.t Queen Anns County Sc.t Be it Remembered that on the Tenth day of September Anno Domini One Thousand and seven hundred and fifty three James Butler James Rosberry and Mary his Wife Partys to the within Written Deed personally came and appeared before Us the Underwritten two of the Right Honourable the Lord Proprietors his Justices for the County afsd and severally Acknowledged the same Deed within Written to be their Act and Deed and the same Mary being first by Us Privately examined out of the sight and hearing of her said Husband declared and said that she made over the same Acknowledgement Voluntarily and freely and without being Compelled or Induced thereto by fear of his Displeasure in Testimony whereof we have hereunto set our hands the Day and Year above Written Jas Brown 7 sides Recorded Sept.r 21.st 1753 Jn Seegar Ex.d This Indenture made this Tenth day of September in the Year of our Lord seventeen hundred and fifty three Between James Butler of Queen Annes County in the Province of Maryland Planter of the one part and James Roseberry the same County Planter and Mary his Wife of the other part Whereas the same James Butler in April Term last past did Commence Prosecute & bring one Writ of Entry sur Disseisin against the same James Roseberry and Mary his Wife thereby Demanding all those Two several Parcels of Plantable Land lying and being in Queen Annes County aforesaid being parts of a Tract of Land called Brotherhood one of which parts lying to the South Eastward of the Land called Fox Hill and the other to the South Westward of a Parcel of the same Tract called Brotherhood which was Sold and Conveyed to Richard Clouds being the parts of the same Tract which by the last Will and Testament of Edward Wright Jun.r late of the same County were given and Devised to the same Mary Daughter of the same Edward Containing by Estimation two hundred Acres of Land more or less with the Appurtenances unto which (same) |
