377) Sold, Aliened, Enfeoffed, Confirmed and made over as by these Presents he the said Thomas Digges doth for himself and his Heirs Give Grant Bargain Sell Alien Enfeoff Confirm and make over unto the said Ignatius Digges his Heirs & Assigns for ever All that Tract or Parcel of Land called Mountain Prospect lying in Frederick County Containing Six hundred Acres more or less Originally Granted on or about the Twenty eighth day of June Anno Domini One Thousand seven hundred forty and five unto the aforesaid Thomas Digges, Together with all Houses & Improvements thereon or thereto belonging to the only proper Use and Behoof of him the said Ignatius Digges his Heirs and Assigns, To have and to hold the Land & Premisses aforesaid with all and singular the Improvements Conveniencies and Advantages thereon or thereto belonging or in any ways Appertaining unto him the said Ignatius Digges his Heirs and Assigns for ever And the said Thomas Digges doth hereby Covenant Promise and Agree to and with the said Ignatius Digges his Heirs and Assigns that the said Tract of Land is at the time of the Ensealing and Delivery of these Presents Clear and free of and from all manner of Incumbrances whatsoever save only the Quit Rents hereafter to grow due to the Lord Proprietary for the time being In Witness whereof the said Thomas Digges hath hereunto set his hand and Seal the day and Year first above Written Signed Sealed & Delivered in the Presence of Us Thomas Digges Seal John Hepburn Charles Carroll Jun.r On the back of the aforegoing Deed was thus Endorsed Viz.t July 7.th 1753 Then Received of Ignatius Digges Esq Six hundred Pounds Sterling being the Consideration Money within mentioned Received P Witnesses John Hepburn Thomas Digges Maryland fs.t July 7.th 1753 Then Came before me one of his Lordships Justices of the Provincial Court Thomas Digges Party to the within Deed and Acknowledged the same to be his Act and Deed for the Uses within mentioned the Year and Day above Written Before John Hepburn 23 July 1753 Received for the Use of the Right Honourable the Lord Baltimore Twenty four Shillings Sterling being for the Alienation Fine of the within mentioned six hundred Acres of Land Benj.a Tasker Recorded July 23.d 1753 4 1/2 Ex.d This Indenture made this Twenty seventh day of June in the Year of our Lord One Thousand seven hundred and fifty three Between William Campbell of Queen Annes County Planter of the one part and John Primrose of the same County Planter or the other part Whereas the same William Campbell in April Term last past did Commence Prosecute and being one Writ of Entry sur Disseisin against the same John thereby Demanding All that Tract or Parcel of Plantable Land being part of a Tract of Land called Hambletons Hermitage lying heretofore in Talbot County but now in Queen Annes County on the South side of Chester River and on the North side of the (Dividing) |
