378) Dividing Branch Beginning at a marked Oak being the Eastermost Bounded tree of a Parcel of Land called Prise Hill and running up a Creek called Hambletons Creek for Breadth East Seventy five Perches to another marked Tree standing by a deep Valley and from thence North three hundred and twenty Perches thence West seventy five Perches thence South three hundred and twenty Perches to the afsd Beginning Tree bounded on the West by the Land called Prise Hill and on the South by Hambletons Creek aforesaid Containing and laid out for One hundred and Fifty Acres of Land more or less with the Appurtenances thereunto belonging unto which same Writ the same John Primrose did appear and did Vouch to Warranty thereof Richard Goldsmith who being present in Court in his Proper Person Warranted the Lands & Tenements afsd described with the Appurtenances unto the same John Primrose and afterwards departed in Contempt of the Court and made default whereby a good perfect and common Recovery of the said Land Tenements & Appurtenances with single Voucher over according to the form and Course of Common Recoverys in such Case Used was in due form of Law suffered and executed Now this Indenture Witnesseth that the same William Campbell and John Primrose for themselves and each of them their and each of their Heirs Executors and Administrators & Assignes do hereby Covenant Promise Grant ^declare^ and Agree to and with each other their and each of their Heirs Executors Administrators & Assigns by these Presents that the true Intent and meaning of the same Recovery and of the Parties thereunto and to these Presents was and is and it is by these Presents and the Partys thereunto declared that the said Common Recovery and all Effects thereof shall be and enure and shall be Construed & taken to be and enure to the only Uses Intents and Purposes hereafter mentioned that is to say All that part of the Tract of Land aforesaid Contained within the Lines and Boundarys above mentioned called Hambleton's Hermitage with the Appurtenances shall be and enure and shall be Deemed Adjudged and taken and is meant and intended and by all the said Parties to these Presents it is hereby declared to be & enure to and for the only Use of him the said William Campbell shall stand and be Seized of all and singular the Parcel of Land abovementioned Contained within the Lines and Boundarys abovementioned and every part thereof with the Appurtenances to & for the only proper Use and Behoof of him the same William Campbell his Heirs & Assignes for ever and to and for no other Use Intent or Purpose whatsoever In Witness whereof the Parties aforesaid to these Presents have hereunto Interchangeably set their hands & Seals the Day and Year first above Written Sealed and Delivered W.m Campbell Seal in Presence of R.d Tilghman Philemon Green John Primrose Junior Seal On the Back of the aforegoing Deed was thus Endorsed Viz.t On the twenty seventh day of June Anno Domini 1753 William Campbell and John Primrose the Partys in the within written Deed Indented Named Personally Came and Appeared before me the Underwritten one of the Right Honble the Lord Propry that now is his Justices of the Provincial Court of Maryland and did Acknowledge the same Deed to be their Act and Deed by (them) |
