376) whatsoever both in Law and Equity of him the said Basil Beall of into or out of the said Premisses herein before Granted To have and to hold the said Parcel of Land part of the Tract aforesaid and all and singular the Premisses before mentioned to be Granted with their and every of their Rights Members and Appurtenances unto the said David Ross his Heirs and Assigns to the only proper Use and Behoof of him the said David Ross his Heirs and Assigns for ever And Basil Beall Doth hereby Covenant Promise and Agree to and with the said David Ross & his Heirs and Assigns by these Presents that he the said Basil Beall hath made done Committed or wittingly or willingly suffered any Act matter or thing whatsoever whereby or by reason whereof the said above Granted Premisses or any part thereof is are or shall or may be Impeached Charged or Incumbred in Title Charge Estate or otherwise howsoever In Witness whereof the said Basil hath hereunto set his hand and Seal the Day and Year above Written Sealed and Delivered Basil Beall Seal in the Presence of Jn.o Needham John Clagett On the Back of the aforegoing Deed was thus Endorsed Viz.t Received the sixth day of April Anno Dom 1753 of the within Names David Ross the Sum of Sixty three Pounds ten shillings Currency being the Consideration within mentioned Witness Jn.o Needham Basil Beall John Clagett Be it Remembered That on the sixth day of April Anno Dom One Thousand seven hundred and fifty three before Us the Subscribers two of his Lordships Justices for the County of Frederick Personally appeared the within named Basil Beall party to the within Instrument of Writing and Acknowledged the same to be his Act and Deed and the Land and Premisses therein mentioned to be the Right and Estate of the within named David Ross his Heirs and Assignes for for ever according to the true Intent and meaning of the same Deed and the Act of Assembly in that Case made & provided At the same time Personally appeared before Us the Subscribers Lucy Beall the Wife of him the said Basil Beall who being Privately Examined a part out of the hearing of her said Husband Declared she made the same Acknowledgment willingly and freely and without being Induced thereto by fears or threats of or Ill Usage by her said Husband or fear of his Displeasure Jn.o Needham 6 Recorded July 18.th 1753 John Clagett Ex.d Maryland fs.t This Indenture made this Seventh day of July in the Year of our Lord God One Thousand Seven hundred and fifty & three Between Thomas Digges of Prince Georges County in the Province of Maryland Gentleman on the one part and Ignatius Digges of the aforesaid Province Esq of the other part Witnesseth that the said Thomas Digges hath for and in Consideration of the Sum of Six Hundred Pounds Sterling to him in hand paid by the said Ignatius Digges the Receipt whereof the said Thomas Digges doth hereby Acknowledge Hath Given Granted Bargained (Sold) |
