370) Ex.d This Indenture made this Thirtieth day of June Anno Domini One Thousand seven hundred and fifty three Between Simon Duff of the City of Annapolis Carpenter of the one part and Walter Dulany of the City aforesaid Gentleman of the other part Witnesseth that the said Simon Duff for and in Consideration of the Sum of Two Hundred and fifty Pounds Sterling Money to him in hand paid by the said Walter Dulany the Receipt whereof he the said Simon Duff doth hereby Acknowledge and himself to be therewith fully Contented and paid Hath Given Granted Aliened Bargained Sold Enfeoffed and Confirmed and by these Presents Doth Give Grant Alien Bargain Sell Enfeoff and Confirm unto the said Walter Dulany one half of two Lots of Land in Proportion to the Lots of the New Town lying in the New Town of the City aforesaid Beginning at the Northermost Post of James Walker's Lot and running North Twenty Degrees East five Perches to Thomas Watsons Lot then Bounding on the same by a line drawn Eighty eight and a half Degrees West sixteen Perches then South twenty Degrees West five Perches to James Walker's Lot and Bounding on the same to the first Post Containing half an Acre of Land more or less Together with the Dwelling House standing on the said Lot (wherein the said Simon Duff now liveth) and all other Houses Buildings and Improvements thereunto belonging or in any wise appertaining To have and to hold the aforesaid half Acre of Land and Premisses together with all the Buildings and Improvements thereon unto the sid Walter Dulany his Heirs and Assigns for ever Together with all Rights Benefits and Priviledges thereunto belonging or to the same in any wise appertaining And the said Simon Duff doth hereby for himself his Heirs Executors and Administrators further Covenant & Agree to and with the said Walter Dulany his Heirs and Assigns that the said Walter Dulany his Heirs and Assigns shall and may for ever hereafter Peaceably and Quietly have hold Use Occupy and Enjoy the aforesaid half Acre of Land and Premisses with all the Buildings and Improvements thereon with their and every of their Appurtenances free and clear of and from all Incumbrances whatsoever And further the said Simon Duff for himself and his Heirs the said half Acre of Land and Premisses with all the Buildings and Improvements thereon and every part thereof against him and his Heirs and against all and every other Person whatsoever Claiming from and under him and them to the said Walter Dulany his Heirs & Assigns shall and will Warrant and for ever defend by these Presents and that he the said Simon Duff and his Heirs shall and will at any time hereafter Execute any further or other Deed Assurance or Conveyance that shall be Devised Advised or Required by him the said Walter Dulany his Heirs or Assigns or his or their Counsel learned in the Law for the further and better Assurance of the Premisses to the said Walter Dulany his Heirs and Assigns so as to Barr in the most effectual manner any Claim or Demand of him the said Simon Duff or his Heirs or any other Person or Persons Claiming from and under him or them In Testimony whereof the said Simon Duff hath hereunto set his hand and seal the Day and Year first above Written Simon Duff Seal (sealed) |
