371) Sealed and Delivered in the Presence of Us TR Read Rich.d Goldsmith On the Back of the aforegoing Deed was thus Endorsed Viz.t Reced of Walter Dulany Two hundred and forty Pounds Sterling being in full for the Consideration Money within mentioned Witness my hand this 30.th of June 1753 Test TR Read Rich.d Goldsmith Simon Duff June 30.th 1753 Then Came before me the Subscriber one of his Lordships Justices of the Provincial Court the within Named Simon Duff and Acknowledged the within Deed according to Law Robert Gordon 6 Recorded July 9.th 1753 Ex.d This Indenture made the Twenty ninth day of June in the Year of our Lord One Thousand Seven hundred and fifty three Between William Kelly of Frederick County Farmer of the one part and Charles Carroll of Annapolis Merchant of the other part Witnesseth that the said William Kelly for and in Consideration of the Sum of Seventy Pounds Sterling Money to him in hand paid by the said Charles Carroll at or before the Execution of these Presents the Receipt whereof he doth hereby Acknowledge Hath given granted bargained sold Aliened Enfeoffed and Confirmed and by these Presents Doth Absolutely give grant bargain and Sell Alien Enfeoff and Confirm unto him the said Charles Carroll his Heirs & Assigns All that part of a Tract of Land called Kellys Delight Granted unto the said William Kelly the Twenty eighth day of June Instant Beginning at the end of the North Twenty four Degrees West One hundred sixty one Perches Line of the said Tract and running the following fourteen Courses being out Courses of the whole Tract that is to say North fifty five Degrees East One hundred Perches North thirty five Degrees West sixty four Perches North forty Degrees East One hundred and two Perches East forty six Perches North fourteen Degrees East ninety nine Perches North eighty four Degrees West ninety four Perches North fifty six Degrees West One hundred thirty five Perches South six Degrees and an half West Two hundred twenty six Perches South thirty Degrees West One hundred thirty five Perches North thirty nine Degrees and an half West ninety three Perches South forth Degrees West One hundred and eight Perches South sixty three Degrees West One hundred ninety one Perches South forty five Degrees East One hundred thirty five Perches North seventy one Degrees and an half East two hundred ninety four Perches then by a streight line crossing the said Land to the beginning Containing Six Hundred and seven Acres together with all Buildings and Improvements thereon or thereto belonging ^or in any wise appertaining^ To have and to hold the above mentioned Land and Premisses with all and singular the Appurtenances unto him the said Charles Carroll his Heirs & Assigns for ever to the only proper Use and Behoof of the said Charles Carroll his Heirs and Assigns for ever And the said William Kelly doth Covenant Grant and Agree as well for himself and his Heirs Executors and Administrators to and with the said Charles Carroll that he the said Charles Carroll his Heirs and Assigns for ever shall and may have hold and Enjoy the said Land and Premisses Warranted and Defended as well (against) |
