310) of Land in the said Writ to be Specifyed unto which Writ the said John Goddart shall appear Gratis and take upon him the Tenancy of the said Lands Tenements & Premisses with the Appurtenances & Vouch to Warranty Joseph Chew party to these Presents who shall likewise appear Gratis and Vouch over the Common Vouchee who shall likewise appear and after make a Departure in spight of the Court so that Judgment shall thereupon be given that the said William Digges shall Recover the said Land and other the Premisses in the said Writ to be Contained against the said John Goddart party to these Presents and the said John Goddart shall recover against the said Joseph Chew Party to these Presents and the said Joseph Chew party to these Presents shall recover in Value against the said Common Vouchee and that Execution of the said Recovery so to be had shall be made according to the form of Common Recoverys in such Case Used And further the said William Digges and Joseph Chew partys to these Presents and the said John Goddart party to these Presents and either and every of them shall and will do Acknowledge Execute and suffer all and every such Act and Acs thing and things whatsoever meer Necessary or Expedient for he Prosecution of the said Recovery and the Execution thereupon according to the form & Order of Common Recoverys with double Voucher in such Cases used, And it is further Covenanted by and between all the Parties to these Presents and either of the said Parties doth by these Presents Covenant Grant Conclude Condescend and fully Agree to and with the other in manner and form following that is to say that the said Recovery of and singular the Lands & Premisses shall for ever immediately from and after the Recovery and Execution had be and remain & all & every other Person or Persons which now or at the time of the said Recovery to be had or who shall be Seized thereof or any part thereof by force or Virtue of the said Recovery shall stand and be Seized of all and singular the Lands and Premisses or any part thereof to the only Use and Uses hereafter exprest and not to any other Use Intent or Purpose whatsoever, That is to say, to the only Use & Behoof of the said William Digges his Heirs & Assigns for ever and to no other Use Intent or Purpose whatsoever In Witness whereof the Partys have hereunto set their hands & seals the Day and Year within Written Sealed and Delivered Jos Chew seal in the Presence of his Geo Fraser John I G Goddart seal Francis King mark W Digges Seal At the foot of the aforegoing Deed was thus Written Viz.t Prince Georges County fs.t July 20.th 1752 Then Came before Us two of his Lordships Justices of the Peace for Prince Georges County afsd Joseph Chew John Goddart and William Digges Partys to the within Deed and Severally Acknowledged the same to be their Act and Deed for the Use Intent and Purpose above mentioned Taken before Geo Frasier Francis King Maryland fs.t Sept.r 21.st 1752 Then Came Mary the Wife of the within mentioned Joseph Chew and being Privately Examined out of the hearing of her said Husband Declared That she freely & willingly Consents to the Recovery within mentioned to and for the Uses and Purposes mentioned in the within Deed and that she freely and Voluntarily Consents thereto and that 8 1/2 she is not Induced to do so thro' threats or fear of her Husbands Displeasure Taken and done in Open Court Recorded Sept.r 21.st 1752 Test R Burdus Clk |
