301) With John Mason Esq.r and Gilbert Joddrel Gentleman thereby giving full Power and Authority unto him the said Commissioners four or three of them whereof the said John Mason or John Locker to be One to Execute the same And Further Reciting that the Major Part of the said Commissioners in and by the said Commission named and Authorized having begun to put the said Commission in Execution upon due Examination of Witnesses and Other good Proof upon Oath before him had and taken did find that the said John Philpot and John Hutchinson for the space of four Years then last past before the date and suing forth of the said Commission carried on and used the Trade ^and business^ of Merchants in Importing Buying and selling Tobacco Skins Iron and other Goods Wares and Merchandizes as other persons of the same Way of Trade usually did and thereby sought and endeavoured to get their Living and that they the said John Philpot and John Hutchinson in the Judgment of the Major Part of the said Commissioners in the said Commission named and Authorized did before the Date and suing forth of the said Commission become Bankrupts according to the true intent and meaning of the several Statutes made Concerning Bankrupts some or One of them and were by them declared Bankrupts accordingly And further Writing that the Major Part of the said Commissioners in and by the said Commission named and Authorized in further execution of the said Commission met at the Guildhall of the City of London pursuant to notice in the London Gazette for that purpose given and the Major Part of the Creditors of the said John Philpot and John Hutchinson then present who had proved their Debts under the said Commission and whose Debts severally amounted to Ten Pounds and upwards did nominate and Choose the said William Tower Bartholomew Pomeroy and Joseph Janson to be assignees of the Estate and Effects of the said John Philpot and John Hutchinson under the said Commission and desired the Major Part of the Commissioners named and Authorized ^in and^ by the said Commission to make an Assignment of the said John Philpot and John Hutchinson's Estate and Effects to them the said William Tower Bartholomew Pomeroy and Joseph Janson accordingly and that the Major Part of such Commissioners had accordingly at the Request of the said William Tower Bartholomew Pomeroy and Joseph Janson made an assignment of the said John Philpot and John Hutchinson's Personal Estate and effects as in and by the said recited Commission and the Depositions and proceedings thereupon had and taken and the said Assignment ^might^ more fully appear, And further Reciting that the said Commissioners parties thereto had found that the said John Philpot and John Hutchinson at the Time they became Bankrupts or afterwards was seized in their Demesne as of Fee Simple or some other good Estate of Inheritance or otherwise Interested on ^and^ entituled to divers Messuages Lands Grounds Tenements Hereditaments and Premises with their Appurtenances and other Estates of Inheritance lying and being as well in Great Brittain as in divers other Parts and places beyond the Seas, It is Witnessed by the said Indenture or bargain and sale now Reciting that the said Commissioners parties thereto in further execution of the said Commission and by Force and Virtue thereof and of the several Statutes therein metioned and more Especially of An Act of Parliament made and passed in the fifty year of his present Majesty's Reign and for divers other Considerations therein mentioned Did as much as in them lay and they lawfully might order Bargain Sell Assign and set over unto the said William Tower Bartholomew Pomeroy and Joseph Janson (their) |
