213) Ex.d This Indenture made the Twenty sixth Day of October in the Year of our Lord God seventeen hundred and fifty one Between Samuel Howard of Ann Arundel County in the Province of Maryland Planter of the one part and John Brice of the County and Province afs.d Gentleman of the other part Whereas the said Samuel Howard by his certain Indenture bearing date the eighth day of February in the Year of our Lord seventeen hundred and forty three made or mentioned to be made between the said Samuel Howard and the said John Brice did for the Consideration therein mentioned Give Grant Bargain Sell Alien Enfeoff and Confirm unto him the said John Brice sundry Tracts or Parcels of Land and several Goods & Chattels with a Condition or Proviso in the said Indenture contained that in Case the said Samuel Howard his Heirs Executors or Adm.rs should well and truly pay or cause to be paid unto the said John Brice his Heirs or Assigns the Sums of two hundred eighty three Pounds Current Money with legal Interest from the tenth day of Sept.r 1743 and also the Sum of five Shillings Current Money with legal Interest on the afs.d Sums of two hundred and eighty three pounds & five Shillings Current Money from the afs.d eighth day of February Anno Dom 1743 at or upon the tenth day of August which should be in the year of our Lord seventeen hundred and forty seven the Interest on the said Sums to be paid Annually as the same should become due that then the said Indenture should be Voyd otherwise to be and remain in full force and Virtue in Law as by the said Indenture recorded in the Provincial and County Court Land Records may more fully and at large appear And Whereas the Sums of two hundred eighty three Pounds and five Shillings Current Money nor any part thereof nor the Interest due thereon were not on the afsd Tenth day of August seventeen hundred and forty seven paid by the said Samuel Howard to the said John Brice (except one Years Interest) but the same & every part and parcel thereof (except as afsd) still remains due and unpaid And Whereas by an Act of Assembly commonly called the Paper Curr.y Act the said John Brice would have been Intituled to have and receive from the Comm.rs of the Paper Curr.y Office one fourth part of all Bills of Credit ^of^ old Tenor which he should have carryed into the said Office on the Twenty ninth day of September One Thousand seven hundred forty & eight and therefore would have been Intituled to one fourth part of the afsd Sum of two hundred eighty three & five Shillings Curr.y together with the Interest due thereon in Ster had the same been paid to him at that time so as he could have carryed it into the said Commiss.rs & which said Sums last mentioned together with the Interest due thereon over and above the Years Interest before said to be reced Amounted on the said twenty ninth day of Sept.r 1748 to the Sum of three hundred and fifty one Pounds nineteen Shillings and Five pence which being reduced to Office Terms amounted to the Sums of two hundred thirty and four Pounds thirteen Shillings Current Money and the Sum of eighty seven Pounds nineteen Shillings and ten pence Sterling and which said Sums the afsd Samuel Agreed to pay to the said John Brice and which said last mentioned Sums from the afs.d twenty ninth day of September 1748 until this day together with the Interest due thereon remains unpaid and is still due Sum of two hundred fifty four Pounds thirteen Shillings and six pence Sterling to Charles Carroll Esq.r being the Principal & Interest due on two Bonds Entered up in the Provincial Court by the said Charles against the said Samuel and on which the said Charles had sued (out) |
