       four Perches to a Bounded red Oak standing on a Point then North forty Degrees
       East One hundred and twenty Perches to a Bounded Beech standing on a Hill
       side in the East line of the said Tract then to the Beginning Containing two
       hundred and twenty five Acres and for Conveying and Assuring the same to the
       Use of the said William Howard his Heirs and Assigns forever The said Thomas
       Sparrow at the Costs and Charges of the said William Howard should sue forth and
       Prosecute out of his Lordships high Court of Chancery of this Province one or more
       Writ or Writs of Entry sur Disseisin in the Post returnable before his Lordships
       Justices of the Provincial Court at Annapolis in September Term in the Year of
       our Lord One Thousand Seven hundred & fifty one thereby Demanding by Apt
       Words and Convenient Descriptions the Land and Premisses afs.d against the said
       William Howard Tenant of the Freehold in the said Land and Premisses To
       which said Writ or Writs of Entry the said William Howard should appear Gratis
       in his own proper Person and Vouch over to Warranty the Common Vouchee of the
       same Court and that the said Common Vouchee also should appear and attest to
       Imparlance make default so as Judgment should and might be thereupon had
       and given and a good perfect and ^absolute^ Common Recovery might be had and duly
       Levyed and Suffered and that Execution might be thereupon had and awarded
       accordingly and all and every other Act and thing might be done & executed
       needfull and requisite for the suffering and perfecting such Common Recovery
       as aforesaid with Vouchers as afs.d And Whereas such Recovery in
       Pursuance of the afs.d Agreement hath been had Levyed and Suffered as may
       more fully and particularly appear by the Records and Proceedings of the afs.d
       Provincial Court referrence being thereunto had Now this Indenture
       Witnesseth and it is hereby and by these Presents Declared and Agreed by
       and between the Partys hereunto and such was the Intent and meaning of the
       said Recovery so as afs.d or in any other manner or any other time or times suffered
       or to be suffered had done Levyed suffered or executed or hereafter to be had
       made suffered levyed or executed of the afs.d Land and Premisses by or between
       the said parties to these Presents or any of them shall be and enure and shall be
       Adjudged Deemed Construed and taken to be and enure and hereby are declared
       by the said Parties to these Presents to be and enure and the Recoveror aforesaid
       and his Heirs shall stand and be seized of the Land & Premisses afs.d to and for
       the Proper Use and Behoof of him the aforesaid William Howard his Heirs and
       Assigns for ever and to and for no other Use Intent or Purpose whatsoever
       Sealed & Delivered
