207) Recovery or Recoverys as aforesaid and it is hereby Declared and Agreed by and between all the said Parties to these Presents that from and immediately after the suffering and perfecting the said Common Recovery or Recoverys so as afs.d or in any other manner the same shall be and enure and shall be Adjudged Deemed Construed and taken and so are and were meant and intended to be and enure and the Recoveror or Recoverors in the said Recovery or Recoverys named and their and every of their Heirs shall stand and be seized of the said Tract of Land with the Appurtenances to and for the only proper Use and Behoof of the said Eleanor Wife of the said John Shelton and party to these Presents and of her Heirs and Assigns for ever and to no other Use Intent or Purpose whatsoever In Witness whereof the Partys to these Presents have hereunto set their hands & Seals the day and Year first aforesaid Sealed and Delivered John Shelton Seal in the Presence of Eleanor Shelton Seal Jn.o Brice Geo Luxford Seal Thomas Johnson Jun.r Th.s Sparrow Seal On the back of the aforegoing Deed was thus Endorsed (Viz.t) October 1.st 1751 Then Came John Shelton & Eleanor his Wife partys to the within Deed and Acknowledged the same according to the directions of the Act of Assembly in such Cases provided before me the subscriber one of his Lordships Justices of the Provincial Court of Maryland And I Certify that the said Eleanor was ^by me^ examined privately out of the hearing of her said Husband and that she declared that she Acknowledged the within Deed willingly and freely without being induced thereto by fear or threats of or Ill Usage of her Husband or fear of his Displeasure Jn.o Brice Oct.r 1.st 1751 Received Ten shillings Currency the Consideration within mentioned Witness I say received P Thomas Johnson Jun.r John Shelton Recorded Oct.r 4.th 1751 13 Ex.d This Indenture made this fifth Day of October in the Year of our Lord one Thousand seventeen hundred and fifty one Between William Howard of Charles County Gentleman of the one part and Thomas Sparrow of the City of Annapolis of the other part Whereas it was Agreed by and between the Partys hereunto that for Barring Docking Destroying and Extinguishing all Estate tail and all Reversions or Remainder thereupon Expectant or Depending of and in all that part or parcel of a Tract of Land called the three Brothers in Charles County Beginning at a Bounded White Oak the third Bounder of the said Tract called the three Brothers and running thence South four Degrees East One hundred and thirty eight Perches to a Bounded Black Oak standing one a Plain then West and by North one Degree Northerly three hundred and twenty (four) |
