206) Ninety Perches South Ten Degrees West One hundred and eighty Perches South fourteen Degrees East eighty Perches South fifteen Degrees West One hundred and forty Perches South eight Degrees East One hundred and twenty Perches South six Degrees West Sixty Perches then with a streight line to the first beginning Tree Containing and now laid out One Thousand five hundred and fifty Acres of Land with the Appurtenances And also All that Lott or Parcel of Ground lying in the New Town or Addition to the City of Annapolis in Ann Arundel County in the Province afs.d Distinguished in the Platt of the said New Town or Addition to the said City of Annapolis by N.o T with the Appurtenances which was Devised by the said William Parks in Fee Tail to the said Eleanor and the Reversion and Reversions Remainder and Remainders thereof and every part thereof and all the Estate Right Title Interest Property Claim and Demand of them the said John Shelton and Eleanor his Wife or either of them of in or to the said Tract of Land with the Appurtences and Lott of Ground aforesaid with the Appurtenances or any part thereof To have and to hold the said Tract of Land with the Appurtenances & Lott of Ground afs.d with the Appurtenances unto the said George Luxford his Heirs and Assigns for ever to and for the Use and Behoof of the said George Luxford to the Intent and Purpose that the said George Luxford may be and become perfect Tenant of the Freehold of the said Tract of Land with the Appurtenances and Lott of Ground afs.d with the Appurtenances to the end that one or more good and sufficient Common Recovery or Recoverys may be had and suffered in manner herein after mentioned It is hereby Declared and Agreed by and between all the said Partys that it shall and may be Lawfull for the said Thomas Sparrow at the Cost and Charge of the said John Shelton on this Fee and before the end of the Provincial Court now sitting to sue forth and Prosecute out of the high Court of Chancery of Maryland one or more Writ or Writs of Entry Sur Disseisin & so forth returnable and to be returned before the Lord Proprietarys Justices of the Provincial Court thereby demanding by Apt and Convenient Name or Names Quantitys Qualitys Number of Acres and other descriptions the said Tract of Land with the Appurtenances and Lott of Ground aforesaid with the Appurtenances against the said George Luxford to which said Writ or Writs of Entry he the said George Luxford shall appear Gratis in his own Person and Vouch over to Warranty the said John Shelton and Eleanor his Wife party hereto who shall appear Gratis in their own Proper Persons and enter into Warranty and Vouch over to Warranty the Common Vouchee of the same Court who shall also appear Gratis and after Imparlance make default so that Judgment may be had and given thereupon for the said Thomas Sparrow to Recover the said Tract of Land with the Appurtenances against the said George Luxford and for him to Recover in Value against the said John Shelton and Eleanor his Wife and for them to Recover in Value against the Common Vouchee and Execution shall be thereupon had & awarded accordingly and all and every other Act and thing done and Executed Sufficient Needfull and Requisite for Suffering and Perfecting such Common (Recovery) |
