204) Tree by a small Creek side thence running North East One hundred and Seventy Perches to a marked Pock hickory Tree standing by the afs.d Creek side thence North West with a Parcel of Land called Brampton two hundred and fifty Perches thence West by South four Degrees Southerly two hundred eighty and two Perches to the first Bounded Oak by the River side on the West with the said River on the North with Brampton on the East with the Creek on the South with Courseys Point containing and laid out for three hundred and ninety & four Acres of Land more or less with the Appurtenances thereunto belonging unto which said Writ the same Ernault and Jane his Wife did appear and ^did^ Vouch to Warranty thereof Richard Goldsmith who being present in the same Court in his Proper Person Warranted the Tract or Parcel of Land afs.d called Conquest with the Appurtenances unto the same Ernault and Jane and afterwards made default whereby a good perfect and common Recovery of the same Tract or Parcel of Land called Conquest with the Appurtenances with single Voucher was in due form of Law suffered and Executed Now this Indenture Witnesseth that the same Robert Hawkins and Ernault Hawkins and Jane his Wife for themselves and each and every of them their and each and every of their Heirs Executors Administrators & Assigns Do hereby Covenant Promise ^Grant^ Declare and Agree to and with each other their & each and every of their Heirs Executors Administrators and Assigns that the true Intent and meaning of the afs.d Recovery and of all the Partys thereunto and to these Presents was and is and it is by these Presents and the Partys aforesaid Declared that the said Common Recovery and all Effects thereof shall be and enure and shall be Construed Deemed and taken to be and enure to the only Use and Behoof of the afs.d Jane Hawkins Wife of the afs.d Ernault Hawkins her Heirs and Assigns for ever and to no other Use Intent or Purpose whatsoever and that the afs.d Robert Hawkins and his Heirs and all and every other Person and Persons whatsoever who shall stand or be seized of all or any part of the afs.d Tract or Parcel of Land called Conquest with the Appurtenances by Force and Virtue of the Recovery afs.d or otherways howsoever shall stand and be seized thereof and of every part and parcel thereof with the Appurtenances to and for the proper Use and Behoof of the same Jane her Heirs and Assigns for ever and to no other Use Intent or Purpose whatsoever In Witness whereof the Partys afs.d have to these Presents Interchangeably set their hands and Seals the day and Year first above Written Sealed and Delivered in presence of Robert Hawkins seal W.m Hopper Nathan Wright On the Back of the aforegoing Deed was thus Endorsed (Viz.t) Queen Anns County fs.t Be it Remembered that on the fourth day of October Annoq Domini One thousand seven hundred & forty nine the within named Robert Hawkins Personally appeared before Us two of his Lordships Justices of the Peace for the County afs.d and did Acknowledge the within Written Bond (to) |
