125) Tree of the said Tract of Land and running from thence South One hundred and Ninety five Perches West One hundred Twenty four and a half Perches North One hundred and ninety five Perches to Intersect the East line drawn from the said Poplar then with the said East line to the beginning thereby Closing the Survey Containing and laid out for One hundred & fifty Acres and all houses Buildings and Appurtenances whatsoever thereunto belonging and all ^and every the Lands Tenements Hereditaments Woods Trees Waters Ways Easements Emilaments Rights Members and Previledges^ ^thereunto or to any part or Parcel thereof belonging or^ Appertaining or at any time now or heretofore Used Occupied Enjoyed Reputed Deemed or taken as part parcel of Member thereof together with the Reversion or Reversions Remainder and Remainders thereof and all the Estate Right Title Claim Property and Demand whatsoever either in Law or Equity of him the said William Hutchman of in or to the same hereby Granted Premisses and every part thereof To have and to hold all and Singular that part of a Tract of Land called Holland Tenements Hereditaments Premisses and Appurtenances thereunto belonging or in any manner appertaining unto him the said Anthony Smith his Heirs and Assigns forever And the said William Hutchman for himself his Heirs Executors and Administrators doth hereby Covenant Grant and Agree to and with the said Anthony Smith his Heirs and Assigns that the afsd hereby Granted and Bargained Tract of Land and Appurtenances notwithstanding of any Act or Acts Deed or Deeds or other matter or thing by him the said Hutchman already had made Committed or done ^(or hereafter to be had made Committed or done)^ now are and from henceforth forever shall remain Continue and be unto the said Smith his Heirs and Assigns free and Clear and freely and Clearly Acquitted Exonerated and discharged of and from all former and other Gifts Grants Bargains Sales ^Leases^ Mortgages Titles Troubles and Incumbrances whatsoever of him the said Hutchman his Heirs or any other Person or Persons whatsoever by from or under him or them Claiming or who hereafter shall Claim any Right Title or Interest thereon and that the said Smith his Heirs or Assigns shall and may at all times hereafter Peaceably and Quietly have hold Occupy Possess and Injoy all and Singular the af.d Granted Tract of Land Premisses and Appurtenances without the least hindrance interruption or incumbrance of him the said Hutchman his Heirs or any other Person or Persons by from or under him or them Claiming or hereafter of and with the Premisses and Appurtenances thereunto belonging and every part thereof as will against him the said Hutchman as against all others Person and Persons whatsoever Claiming or who shall Claim any Right Title Interest or Property therein or in any part thereof by from or under him the said Hutchman or his Heirs unto the said Smith his Heirs and Assigns shall and will Warrant and forever by these Presents defend In Witness whereof the said Hutchman hath set his hand and Affixed his Seal the day and Year first above Written Sealed and Delivered in the Presents of W.m Hitchman Seal Benj.a Hall James Evans On the back of the aforegoing Deed was thus Endorsed Viz.t Be it Remembered on the Eighth day of April Anno Dom One Thousand Seven hundred and Fifty and William Hutchman the Grantor within named Personally Appeared before me the Subscriber one of his Lordships Justices of the Provincial Court and Acknowledge the within Instrument of Writing to be his Act and Deed and the Land and Premisses therein mentioned to be the Right and Estate of the within mentioned Anthony Smith and his Heirs according to the Commission of the Act of Assembly in that Case made and Provided Acknowledged before me this 11.th day of April 1751 [illegible] April the 11.th 1751 Received six Shillings Sterling for the Alienation fine on the within mentioned One hundred and fifty Acres of Land for the use of the Lord Baltimore by Virtue of a Commission from Benjamin Tasker Esq.r his ^said^ Lordships Agent and Receiver General Rich.d Dorsey 8 1/2 Recorded April 11.th 1751 |
