124) Mortgages Titles Troubles Charges and Incumbrances whatsoever had made done Committed or Willingly suffered by him the said George And also that ^at^ any time or times after such Default he the said George Parker his Heirs and Assigns and every other Person and Persons Lawfully Claiming or having any Estate or Interest of or in the said Premisses or any part thereof by from under or in Trust for him shall and will upon the request of the said Samuel Ogle his Heirs and Assigns make do Acknowledge Levy suffer and Execute all such further and other Acts matters things Devises Conveyances and Assurances in the Law whatsoever for the further and better Assuring and Conveying the said Premisses unto the said Samuel Ogle his Heirs and Assigns aforesaid as by him or them or his or their Council Learned in the Law shall be reasonably Devised Advised or required In Witness whereof the said George Parker hath hereunto set his hand and Affixed his Seal the Day and Year abovesaid Sealed and Delivered in the Presence of Geo Parker Seal Add.n Murdock Dan.l Dulany Jun.r On the back of the aforegoing Mortgage was thus Endorsed (Viz.t) Received the within mentioned Sum of five Shillings the day and year within mentioned as Witness my hand Witness Add.n Murdock Geo Parker March 25.th 1751 Then Came before me the Subscriber one of his Lordships Justices of the Provincial Court the within Named George Parker and did Acknowledge the within Instrument to be his Act and Deed and the Premisses therein mentioned or intended to be Granted to be the right and Estate of his Excellency Samuel Ogle Esq.r within named for the Use and Purposes and according to the true Intent and meaning of the within Deed the above Acknowledgment taken by me Geo Steuart Maryland Charles County March the 30.th 1751 Then Came before me the Subscriber (one of the Justices of the Provincial Court) Elizabeth Parker Wife of the within mentioned George Parker and relinquished her Right of Dower of in and unto the Lands and Premisses in the within Deed mentioned and being by me at the same time Examined privately and apart from and out of the hearing of her Husband afsd Declared that she Relinquisht her right Voluntarily and freely without being Induc'd thereto by threats or fear of ill Usage from her Husband afsd or dread of his Displeasure Examined and Certifyed the day and year abovementioned Recorded April 2.d 1751 by Geo Dent 13 Ex.d This Indenture made this eight day of April in the Year of our Lord One Thousand Seven hundred and fifty one Between William Hutchman of Cecil County in the Province of Maryland Gentleman of the one part and Anthony Smith of the same County Gentleman of the other part Witnesseth that the said William Hutchman for and in Consideration of the Sum of Two hundred Pounds Current Money ^of Maryland to him in hand paid by the said Anthony Smith before the sealing and delivery of these Presents^ the Receipt whereof the said Hutchman doth hereby Acknowledge and thereof doth Acquit and Discharge the said Smith his Heirs Executors and Administrators for ever Hath Granted Bargained Sold Aliened Released Enfeoffed and Confirmed and by these presents for himself and his Heirs doth Clearly and Absolutely Grant Bargain Sell Alien Enfeoff Release and Confirm unto the said Anthony Smith his Heirs and Assigns forever part of a Tract of Land called hall and lying and being on the East side of Susquehannah River in Cecil County Beginning at a red Oak (being the extent of an East line drawn from a poplar standing on a high Stoney hill the Northermost Bounded (Tree) |
