120) of the Proviso and Covenant for Payment aforesaid and the true Intent and meaning of these Presents upon every Reasonable request and at the Proper Costs and Charges in the Law of the said Jeremiah Warder and Samuel Neave on the Survivor of them or the Heirs of the Survivor or their Assigns make do Acknowledge Levy Suffer and Execute or Procure to be made done Acknowledged Levied Suffer'd and Executed all and every such Reasonable Act and Acts thing and things devices Conveyances and Assurances in the Law whatsoever for the further ^better^ and more perfect Granting and Assuring unto the said Jeremiah Warder and Samuel Neave or the Survivor of them or the Heirs of the Survivor of their or any of their Assigns in Fee Simple all and Singular and every the Premisses aforesaid freed and Absolutely discharged of and from the aforesaid Proviso or Agreement for redemption of the Premisses or any part thereof and all Equity thereupon as by the said Jeremiah Warder and Samuel Neave or the Survivor of them or the Heirs of the Survivor or any of them or his or their Councel Learned in the Law shall be reasonably Advised or devised and required In Witness whereof the said parties to these Presents have Interchangeably set their hands and seals hereunto Dated the day and Year first above Written Hugh Parker seal Sealed and Delivered In the Presence of In behalf of Samuel Neave Jer.eh Warder seal James McLachlan W.m West At the foot of the aforegoing Deed was thus Endorsed Viz.t Received the day of the date of the within Instrument of Writing the within mentioned Sum of five Shillings Consideration Money Present Hugh Parker James McLochlan W.m West Maryland fs.t March 4.th 1750 Then the within mention'd Hugh Parker and Jeremiah Warder came before me John Brice one of his Lordships Justices of the Provincial Court and Acknowledged the within Instrument of Writing to be their Act and Deed and the within mentioned Lands and Premisses to be the Property of the within mentioned Jeremiah Warder and Samuel Neave under the Provisos and Conditions therein set forth according to the Act of Assembly in such Cases made and provided Recorded March 4.th 1750 Acknowledged before Jn.o Brice Ex.d To all Christian People to whom this present Writing shall come Greeting Know ye that on the third day of May One Thousand Seven hundred and forty nine (English Stile) Before me Lewis Portbury Esquire Mayor of the City of Exeter in the Kingdom of Great Britain and in the Presence of me Richard Langworthy of the same City Gent Notary Publick by Royal Authority Created and Sworn appeared Personally Joseph Elliot of the City of Exeter aforesaid Lether Dresser and Mary his Wife Daughter and one of the Heirs of Thomas Carpenter late of Alphington Mariner Deceased who was Eldest Brother of John Carpenter late of Annapolis in Maryland Merchant deceased and John Burnett of Alphington aforesaid in the County of Devon in Great Britain Sergemaker and Dorothy his Wife another Daughter and one of the Heirs of the said Thomas Carpenter after reciting that the said John Carpenter died Intestate leaving Elizabeth his Widow but no Issue and that they the said Mary Elliott and Dorothy Burnett and Heirs at Law to the said John Carpenter their Uncle deceased and Lawfully Intituled to all his Plantations Lands Tenements and Hereditaments Subject only to the Dower of Elizabeth Carpenter his Widow and that she had entered upon and taken Possession of his Plantations and other his Lands Tenements and Hereditam.ts in Maryland afsd did of their own free Will and Accord make Constitute and (Appoint) |
