121) Appoint Bryan Philpot the Younger Merchant in Maryland to be their true and lawfull Attorney and Procurator and in their Names and to their own Use to make Entry upon the said Plantations and all other the Lands Tenements and Hereditaments late of the said John Carpenter and that now belong to them as his Heirs at Law Subject to the said Elizabeth Carpenters Dower as afsd and for them and in their Names to Sell and Dispose thereof Assoon as Conveniently may be for the most Money that can be had or gotten for the same and in the mean time to lett sett or otherwise dispose thereof as to him shall seem meet and to receive and take the Rents Issues and Profits thereof and upon such Sale and receipt of the Purchase Money thereof (if Sold) or of any other Sum or Sums of Money for the Rents Issues and Profits thereof or otherwise acquittance and Acquittances discharge and discharges or other Deed or Deeds whatsoever relating to the Premisses or the sale thereof for them and in their Names to make Seal and Deliver as their Several Acts and Deeds and Generally to do execute and perform all such other lawfull Act and Acts thing and things whatsoever as shall be requisite and necessary to be done in or about the Premisses as fully and amply as they the said Constituents might do or Cause to be done were they personally Present Promising hereby to Ratify and Confirm whatsoever their said Attorney or Procurator shall do or cause to be done in and about the Execution of the said Premisses In Witness whereof the said Constituents have hereunto Subscribed their Names and sett their Seals in the Presence of me the said Mayor and the said Premisses In Witness whereof the said Constituents said Premisses hereunto set our Names and Publick Seals being thereunto requested the day and Year aforesaid Seal Jos Elliott Seal Lewis Portbury Mayor Mary Elliott Seal of Exeter Jn.o Burnett Seal Seal Richard Langworthy Notary Publick 5 1/2 Recorded April 2.d 1751 Ex.d To all Christian People to whom this present Writing shall come Greeting Know Yee that on the third day of May One Thousand seven hundred & forty nine (English stile) before me Lewis Portbury Esquire Mayor of the City of Exeter in the Kingdom of Great Britain and in the Presence of me Richard Langworthy of the same City Gent Notary Publick by Royal Authority Created and Sworn appeared Personally Joseph Elliot of the City of Exeter aforesaid Lether Dresser and Mary his Wife John Burnett of Alphington in the County of Devon in Great Britain aforesaid Sergemaker and Dorothy his Wife Daughters of Thomas Carpenter late of Alphington afsd Mariner deceased who was Eldest Brother of John Carpenter late of Annapolis in Maryland Merchant Deceased and Ann Radcliffe of Blackawton in the County of Devon afsd Spinster Daughter of Dorothy Radcliffe deceased who was Sister of the said John Carpenter deceased And after reciting that the said John Carpenter dyed Intestate leaving Elizabeth his Widow but no Issue whereby the said Joseph Elliott and Mary his Wife the said John Burnett and Dorothy his Wife and the said Ann Radcliffe are become and are the only Persons Intituled to Dividends of the said Intestates Personal Estate according to the Statute for Settling Intestates Estates And that the said Elizabeth his Widow had taken Letters of Administration of all and Singular the Goods and Chattels of the said John Carpenter in Maryl.d (and) |
