101) of Saint Charles Branch afs.d then with the Branch and ^the^ line of Bean's Landing to the afs.d Stump or Stone Containing Two hundred and fifty Acres of Land more or less To have and to hold the afs.d Tract or Parcel of Land and Premisses with all and Singular the Appurtenances unto the said Daniel Carroll his Heirs and Assigns to the only proper use and Behoof of the said Daniel Carroll his Heirs and Assigns for Ever and to no other use intent or purpose whatsoever Provided Nevertheless and it is the true intent and meaning of these Presents that if or in case he the said Lingan Wilson his Heirs Ex.rs Adm.rs or Assigns ^or any Person or his or their behalf shall and do well & truly Pay & satisfy unto him the said Dan.l Carroll his Heirs Ex.rs Adm.rs or Assigns^ the Just and full Sum of Forty five Pounds paper Currency of Maryland (with Legal Interest for the same at or before the first day of November which shall be in the Year of our Lord seventeen hundred and fifty two that then the above Deed of Bargain and Sale and every Article and Clause contained in the same to be Utterly Void and of none Effect but in case of Failure of the Payment of the said Sum of Forty five Pounds Paper Currency of Maryland with the Interest thereon at the time afs.d then the said Lingan Wilson doth hereby for himself his Heirs Ex.rs and Adm.rs Release all Title Claim or Equity of Redemption of the Premisses and doth hereby fully and Clearly and Absolutely Convey the Land and Premisses afs.d to the said Daniel Carroll his Heirs and Assigns for Ever In Witness whereof the said Lingan Wilson hath hereto set his Hand & Affixt his Seal the Day and Year first above written Memorandum that is Mutually Agreed between the Parties Lingan Wilson Seal abovementioned that the said Lingan Wilson his Heirs or Assigns shall have the liberty & Permission of Paying & Satisfying within the time limited) for Payment any Sum or Sums of Money for & in discharge of the above mentioned Sum with the Interest thereon so far forth as the same shall Amount unto and the said Daniel Carroll for himself his Heirs Ex.rs Adm.rs & Assigns doth hereby Promise to receive the same Sealed and Delivered in the Presence of B Young John Don On the Back of the aforegoing Mortgage was thus Endorsed Viz.t Maryland November the 13.th 1750 Then came Lingan Wilson and acknowledged the within Deed as his Act and Deed to the within named Daniel Carroll his Heirs and Assigns for Ever Subject Nevertheless to the Provisoe within Contained before B Young one of his Lordships Justices of Nov.r the 13.th 1750 Reced of Daniel Carroll the Provincial Court forty five Pounds Curr.t Money being the £ 45 Curr.cy Consideration Money within mentioned as Witness my Hand Lingan Wilson Witness D Carroll junior 4 Decem.r 1750 Reced of the within mentioned M.r Dan.l Carroll Ten Shillings Sterl being for the Alienation Fine of the within Lands I say Reced for the use of the Right Honble the Lord Propry Benj.a Tasker Recorded Decem.r 4.th 1750 8 sides Vide Release of this Mortgage Recorded in fol 244 |
