Ex.d      This Indenture ^Tripartite^ made this Second Day of
       August in the year of our Lord Christ one thousand seven
       hundred and forty five between Benj.a Kirby of y.e
       Island of Kent in Queen Anns County and Province
       of Maryland Planter of the first part Cornelius Brookesby
       of Ann Arundel County & Province af.d Gentleman
       of the Second part and Thomas Williamson of the said
       County and Province af.d Gentleman of the third part
       Witnesseth that the Same Benj.a Kirby as well for
       Docking barring and cutting of all Estates Tail
       Reversions remainders & all other Estate and Estates
       Terms and Interest heretofore erected limited or Declared
       of or for in or Concerning all that Tract or Parcell of Land with the
       appurtenances thereunto belonging Commonly known by the name of ^Bady Neck lying Scituate & being on the North East Side of the Island of Kent in Queen Annes County af.d bounding on the North with the Land of John Russell on the East with the Bay of Chesepeak on the West with Coxes Creek on the South with a line drawn East from the End of the line by Coxes Creek unto the said Bay Containing & laid out for Two Hundred Acres more or less & for the settling & assuring the same grant or parcell of Land with the Appurtenances to & for the Uses intent & purposes herein & hereby limitted expressed mentioned & Declared^
       as for & in Consideration of the Sum of five Shillings
       Current money to the Same Benj.a Kirby in hand
       already paid by the af.d Cornelius & Thomas the
       receipt whereof is hereby acknowledged and for
       Diverse other good causes & Considerations him the
       same Benj.a Kirby thereunto moveing Hath granted
       remised released & Confirmed and by these presents doth
       for himself & his heirs grant Remise Release & Confirm
       unto the af.d Cornelius Brookesby in his actual possession
       now being by Virtue of a bargain & Sale to him thereof
       made for one year by Indenture bearing Date the Day
       next before the Day of the Date of these presents & by
       Virtue of the Statute made for transferring uses
       into possession & to his heirs & assigns all the af.d
