52) On the Back of the aforegoing Deed was thus Endorst Viz.t April 24.th 1745 Then Came the within named Thomas Edmonson before me the subscriber one of his Lordship's Justices of the Provincial Court and acknowledged the within Instrument to be his Act and Deed according to the form of the Act of Assembly in that Case made and Provided acknowledged before me the Day and Year af.d Recorded the 25.th ^April^ 1745 John Hepburn 4 Ex.d This Indenture Tripartite made the Eighteenth Day of March in the Year of Our Lord one Thousand seven hundred and forty four Between Thomas Edmonston of Prince Georges County Gent of the first Part John Smith Prather of Charles County Planter of the second part and Tho.s Jennings of Ann Arundel County Gent on the third part Witnesseth that the said Thomas Edmondson for and in Consideration of the sum of five Shillings Current money of Maryland to him in hand paid by the said John Smith Prather at or before the ensealing and Delivery of these Psents the Receipt whereof is hereby acknowledged Have Granted Released and Confirmed And by these Presents Doth give Grant release and Confirmed unto the said John Smith Prather all those one hundred and ninety Two Acres of Plantable Land being Parcel of a Tract of Land Called Bear Garden Enlarged lying and being in Prince Georges County with their Appurtenances And also all these four hundred and twenty Eight Acres of Plantable Land being Parcel of a Tract of Land called Deer Park lying and being in the County aforesaid with their appurtenances together with all buildings improvements Profits Commodities and Advantages whatsoever to the same belonging late in the Tenur^e^ or Occupation of the said Tho.s Edmonson (but now in the Actual Poss.n of the said John Smith Prather by force of an Indenture of Bargain and Sale thereof made bearing Date the Day before the Day of the Date of these Psents and of the statute for Transferreing ^of^ uses into Possession being (To have and to hold all and singular the above mentioned Parcels of land with all buildings improvements Comodities and Advantages Hereditaments and Premisses with their and every of their Appurtenances hereby Given Granted Released and Confirmed or mentioned or intended to be hereby given granted released and Confirmed unto the said John Smith Prather and his Assigns for and during the Natural life of the said John Smith Prather to the intent and purpose that the said John Smith Prather shall & may be perfect Term out of the freehold of all the said Land & premisses untill one or more good & perfect recovery or Recoverys may be had against him the said John Smith Prather of the same Lands & premisses And it is Covenanted (granted) |
