Ex.d   This Indenture made the nineteenth Day of April in the
       year of our Lord one Thousand Seven hundred & forty two Between
       Edward Ponteny of Baltimore County Carpenter Son & heir of W.m
       Ponteny late of the Province of Maryland Butcher Deceased on the
       one part & Charles Carroll of Ann Ar.l County Surgeon on the other
       ^part^ Whereas the said W.m Ponteny by his Bond or writing Obligatory bearing
       Date the Eighth Day of December in the year of our Lord one Thousand
       Seven hundred & twenty Six did oblige himself his heirs Ex.rs and
       Adm.rs in the Penalty of one hundred Pounds Sterling payable to the
       said Charles Carroll his certain Attorney Ex.rs Adm.rs or assigns
       to which Obligation there was a Condition annexed reciting that
       Whereas the said W.m Pentony stood Justly Indebted & to the said
       Charles Carroll in the full & Just Sum of fifty three Pounds Sterling
       & that he the said W.m was not Oblige to Secure or pay the same
       other than by making over his Right & title to the said Charles
       of a certain Tract of Land called Walnut Neck lying on Patapscoe
       River for & concerning which there was then Depending in the Prov.ll
       Court of the Province a Suit at Law that if the said W.m should
       make over to the said Charles Carroll his heirs and Assigns for ever
       by Deed or otherwise all his the said W.ms Right title & Interest of
       in & to the above mentioned Tract of Land in Case he the said
       W.m should recover a Judgment in the Prov.l Court for the said
       Land or otherwise have Legal possession thereof then the Obligation
       should be void or else remain in force and Virtue & Whereas the
       Suit for the said Tract of Land called Walnut Neck Now this
       Indenture Witnesseth that the said Edward Ponteny as well
       for & in Consideration thereof as for & in Consideration of the
       Sum of ten Pounds Current money of Maryland & Eight
       hundred Pounds of Tobacco to him in hand paid by the said
       Charles Carroll before the ensealing & Delivery of these
