33 Debt of the said Mary Frazier by the said Daniel Dulany paid to Daniel Carroll of Marlborough in Prince Georges County Merchant the receipt whereof is hereby acknowledged hath granted Bargained sold & confirmed & by these presents doth grant Bargain Sell make over & confirm unto the said Daniel Dulany all that messuage in Marlborough Town in Prince Georges County now in the Occupation of Benjamin Berry Innholder together with all other houses stables Gardens back fields yards and other improvements & all the Lott or Lotts Portion or Portions of ground whereon the said messuage & other the premes are erected & also all that Lott or portion of ground lying in the same town of Marlborough N.o 35 which Thomas Butler sold & convyed to the said Mary Frazier with all buildings & Improvements ^thereon & Appurtenances^ thereunto belonging together with all arrears of rent now Due or owing to ^from^ the said Benj.a Berry To have & to hold to him the said Daniel Dulany his heirs & Assigns for ever to his & their own use & the said Mary Frazier for herself & her heirs doth covenant & agree to & with the said Daniel Dulany his heirs & Assigns that he & they shall & may have hold & peacebly possess & Enjoy all & Singular the Bargained premisses with any let molestation or Disturbance whatsoever Provided always & it is the true intent & meaning of these presents that if the said Mary Frazier shall well & truly pay unto the said Daniel Dulany his Execut.rs Adm.rs or assigns the said two hundred & fifty Pounds Current Money of Maryland & the lawfull Interest thereof at the Dwelling house of the said Daniel Dulany in Annapolis on or before the fourteenth Day of February next Ensueing then these presents to be void & of none Effect else to be in full force & Virtue & the same Mary Frazier for herself her heirs Ex.rs Adm.rs doth covenant grant & agree to & with the said Daniel Dulany his Ex.rs Adm.rs & Assigns that she or they will well & truly pay the said two hundred & fifty Pounds with the Interest thereof according to the true Intent & meaning of these presents In Witness whereof the said Mary Frazier hath hereunto set her hand seal the Day & year first above written Sealed & Delivered Mary Frazier Seal in the Presence of On the Back of the aforegoing mortgage was thus Endorst Viz.t John Brice Febr.y 14.th 1744 I acknowledge that Ann Turner the within consideration money was payed at my request by the (within) |
