241) Name of Whitakers Chance lying and being in Annarundel County af.d upon Elkridge To have and to hold the said One hundred and fifty Acres of Land together with all and Singular the Premisses and Appurtenan.s thereunto belonging to him the said Robert Tivis his Heirs and Assig.ns forever for and in Exchange of and for the said Lands Tenements and Hereditaments called Whitakers Chance with the Appurtenances & the said Philip Hammond for himself and his Heirs doth Covenant and Grant to and with the said Robert Tivis his Heirs Ex.rs and Adm.rs that he the said Robert and his Heirs shall and may from time to time and at all times hereafter peaceably and Quietly have hold Occupy Possess and Enjoy the said One hundred and fifty Acres of Land and Premisses without the Let trouble Hindrance Molestation Interruptions Denial of him the said Philip Hammond his Heirs and Assigns and every of them and ^of^ all and every other person and persons whatsoever Claiming in ^by^ from or under him them or any of them In Witness whereof he the parties first above mentioned hath hereto set his hand and Affixed his Seal the Day and year first above written Phi Hammond seal Signed Sealed & Delivered in the presents of Us Jn.o Brice On the Back of the aforegoing Deed John Worthington was thus Endorst (Viz) December 8.th 1746 Then Came Philip Hammond and Acknowledged the within Instrument as his Act and Deed and the Land and Premisses he therein Conveyed to be the right and Estate of the within named Robert Tivis his Heirs and Assigns forever and at the same time Rachell the wife of the said Philip being privately Examined out of the hearing of her said Husband Acknowledged that she freely and willingly gave up all her right title and Interest of in and to the said Land unto him Robert Tivis his Heirs and Assigns without any fear of threats on the displeasure of her said Husband and according to the Act of Assembly in such Cases made and Provided before me the Subscriber one of his Lordships Justices of the Provincial Court the Day and year first above written Jn.o Brice Received of M.r Philip Hammond Six Shillings Sterling for his Lordships use (it being the Alienation fine on the within (mentioned) |
