       such Cause & Causes of actions or suits Bills Bonds Debts
       Dues Duties accounts Reckonings sum & sums of money
       and all controversies Diferences & Disputes whatsoever which
       against the said Samuel Hyde he the said Charles Lord
       Baltimore now hath or ever had or which he the said Charles
       Lord Baltimore his ^Heirs^ Executors or administrators shall
       or may have claim Challenge or Demand against the said
       Samuel Hyde his heirs Executors or administrators for
       any matter cause or thing from the beginning of the World
       unto the Day of the date of these presents Provided
       always nevertheless and upon this Condition that if the
       grant bargain sale and assignment made or intended to
       be made by this present Indenture is or shall be defeated
       or made Voyd & of no Effect by reason of any Act Default
       or procurement of the said Sam.l Hyde that then the
       release herein before mentioned from the said Charles
       Lord Baltimore to the said Samuel Hyde is to determine
       & be of no Effect and the said Charles Lord Baltimore is to
       Stand & be as a Creditor to the said Samuel Hyde for the
       said sum of six thousand Eight hundred ninty three Pounds
       thirteen shillings & is to be entituled to all such remedies &
       relief for the recovery of the same as he would have been if
       these presents had not been made or Executed And the
       Said Charles Lord Baltimore for himself his heirs Exors
       Admors & assigns doth Covenant promise & agree to & with
       the said Samuel Hyde his Exors & Admors that in Case he
       the said Charles Lord Baltimore shall make use of the name
       of the said Samuel Hyde in any Indorsment or Indorsments
       or any Bill or Bills as af.d or in the commencement or prosecution
       of any suit or suits for the obtaining & recovering the said
       Debt or Debts of & from the said person or persons in the
       Schedule or Inventory hereunder written or any or either
       of them or otherwise by Virtue or in pursuance hereof that
