87 & discharge hath Given granted bargained and sold and by these Presents doth Give Grant bargain & sell unto the said Daniel Dulany two hundred Acres of Land being part of that Tract or parcell of Land in Baltimore County Called Northwich Containing four hundred & fifty seven Acres which was granted to Thomas Long as appears by the Grant or Pattent thereof recorded in Lib M M fol 716 among the Land Records & which was sold and Conveyed to Doctor James Kingsberry deced father of the said James with all Buildings Improvements Profits Appurtenances & Advantages there unto belonging To have and to hold to the said Daniel Dulany his Heirs & Assigns for Ever to his and their own proper use & behoof & to no other use or Intent or Purpose whatsoever And the said James Kingsberry for himself and his Heirs doth Covenant and Agree to and with the said Daniel Dulany his Heirs and Assignes that he the said James at the time of the Ensealing & Delivery of these presents hath good right & title Absolute and Lawfull Authority to sell and Convey the Premisses according to the true intent & meaning of these present & is thereof seized in his Demesne as of Fee And the said James Kingsberry doth further Covenant & agree to & with the said Daniel Dulany his Heirs & Assigns that he the said James & his Heirs the bargained Premisses to the said Daniel Dulany his Heirs and Assignes for Ever will warrant & defend against all Claims & Incumbrances whatsoever Provided always & it is the true intent & meaning of these presents that if the said James Kingsberry shall well & truly pay unto the said Daniel Dulany his Executors Adm.rs or Assignes the above sum of Twenty pounds Eight Shillings Sterling with the Lawfull Interest thereof on or before the Twenty Seventh Day of August which shall be in the Year of our Lord Seventeen hundred & forty at the Dwelling House of him the said Daniel Dulany at Annapolis Then & upon such payment then presents to be absolutely Void And the said James Kingsberry for himself & his Heirs doth Covenant & agree to and with the said Daniel Dulany his Exors Admors & Assignes to pay the said Twenty Pounds Eight Shillings Sterling according to the Tenour of these Presents Sealed and Delivered in the James Kingsbury Seal presence of us the Words (Eight Shillings) first interlined and also the words (two hundred Acres of Land being part of) Robert Gordon Tho.s Addison On the back of the aforegoing Deed was thus Endorst Viz.t Sterl Feb.ry 27.th 1738 Reced the within sum of Twenty Pounds Eight Shillings £ being the Consideration within Mentioned 20 8 0 Robert Gordon Ja.s Kingsbury Tho.s Addison Feb.ry the 27.th 1738 Then did the within named James Kingsbury acknowledge the within Deed before me according to Act of Assembly Vide Assignment of this Mortgage Recorded in Liber EI Robert Gordon N.o 12 fol 266 Recorded Feb.ry 28.th 1738 |
