54) intended to be bargained & sold to the s.d Anthony Simms his Heirs & Assigns for Ever to his & their Proper use & behoof And the said Marmaduke Electious & Fidelimus Simms & Bathia Higdon doth for themselves their Heirs Exec.rs & Adm.rs further Covenant Grant and Agree to & with the said Anthony Simms his Heirs & Assignes that the said Anthony shall peaceably Enjoy all & Singular the before bargained Premisses with the Appurtenances without any Manner of Trouble molestation or interruption of or by the said Marmaduke Electious & Fidelimus Simms & Bathia Higdon or Either of them or either of their Heirs Exec.rs or Adm.rs or by any manner of Person or Persons whatsoever lawfully Claiming or Pretending to Claim right to the fores.d bargained prems from or Under them then or either of them their or Either of their Heirs Exec.rs or Adm.rs or by their or Either of their Estates Titles means or procurement And the said bargained Premisses now is & for Ever hereafter shall be & remain free & Clear & freely and Clearly acquitted Exonerated and Discharged of & from all Manner of Former Bargains Sales Gifts Grants Mortgages Joyntures dowers rights or Titles of Dower whatsoever the Rents hereafter to become due to the Lord Proprietarie his Heirs & Successors always Excepted & foreprised And the said Marmaduke Electious & Fidelimus Simms & Bathia Higdon or either their or Either of their Heirs Exec.rs or Adm.rs the before bargained Premisses with all & Singular the Appurtenances unto the said Anthony Simms his Heirs and Assignes shall & will warrant & for Ever defend by these Presents In Witness whereof the Parties first above named have hereunto set their hand & affixed their Seals the Day & Year above Written his Marmaduke M Simms Seal Signed Sealed & Delivered his Mark in Presence of us Electius A Simms Seal Mark Geo Dent his Fidellimus M Simms Seal W.m M.cwilliams her Mark Tho.s Sanders Bathia C Higdon Seal Mark On the back of the aforegoing Deed was thus Endorst Viz.t Maryland 8.th August 1738 Then Came Marmaduke Elexius & Fidelimus Simms and Bethia (Higdon) |
