503) Along West along the Land of the said Gibson and until it intersect a South South East Line of the Land of a Certain William Welch bounding on the said Intersection and Runing South South East along the Land of the said Welch and unto the first Bounded Tree Containing One Hundred Acres of Land more or less To have and to hold the said Tract or Parcell of Land and Premisses hereby Granted Released and Confirmed or intended to be hereby Granted Released and Confirmed with the Appurtenances thereunto belonging unto the same Samuel his Heirs and Assigns to the intent and purpose that he the same Samuel may become a Perfect Tennant of the Freehold of the said Premisses with the Appurtenances whereby One or More Perfect Common Recovery or Recoveries shall or may be thereof had or Suffered in manner and form following For which intent and Purpose it is hereby Covenanted Granted Concluded and Agreed upon by and between all the said Parties to these Presents that it shall and may be Lawfull to and for the said Gideon Pearce to bring and prosecute against the said Samuel Groom One or More Writ or Writs of Entry Sur Disseisin en lo Post Returnable before his Lordships the Right Honourable the Lord Proprietarie's Justices of his said Lordship's Provincial Court to be held for the Province aforesaid at the City of Annapolis in the said Province on the Second Tuesday of April next of and for the said Tract or Parcell of Land Contained within the Lines & Bounds af.d and Premisses with the Appurtenances, to which said Writ or Writts the same Samuel shall appear Gratis and Vouch to Warranty the said Philemon Part to these Presents who also shall appear and Enter into the Warranty And shall Vouch Over the Common Vouchee who also shall appear and Enter into the Warranty for the said Premisses and afterwards make Default so that One or more Perfect Common Recovery or Recoverys with Double Voucher over may be duly had Executed and Perfected to and for the said Gideon Pearce on or before the First Day of June now next Ensueing the Date hereof of and for the said Tract or Parcell of Land contained within the Lines and Bounds af.d and Premisses with the appurtenances thereunto belonging According to the Course of Common Recoveries in such Cases used And it is hereby further Declared concluded covenanted and fully agreed upon by and Between all the said Parties to these Presents and it is the true intent & meaning of All the said Parties and fo these Presents that as well the af.d Recovery or Recoverys so to be Suffered and Executed as all other Recoverys Settlements and Assurances whatsoever had made Levied Executed or Suffered or to be had made Levied Executed or Suffered by and between the Parties af.d to these Presents or by or Between any of them of or for the af.d hereby Granted and Released Land and Premisses with the Appurtenances shall be and Enure and shall be Construed, Deemed, Adjudged and taken to be & Enure, and ^that^ the said Gideon Pearce and his Heirs and all other person & persons whatsoever who now are or hereafter shall be Seized of and in the said hereby granted & Released Premisses shall from and immediately after the passing and Suffering the said Recovery or Recoverys by force and by Virtue thereof And of these Presents stand and be Seized thereof and of Every part thereof to the only proper use and behoof of the same Samuel Groom party to these Presents his Heirs and Assigns for Ever and to no other use Intent behoof or Purpose whatsoever In Witness whereof the parties aforesaid to these presents have (Set) |
