502) Between the same Philemon Church of the first part the same Samuel Groom of the Second Part and Gideon Pearce of the Third Part In Witness whereof the parties afores.d to these presents have Set their Hands and Affixed their Seals the Day & Year first above Written Phill Church Seal Sealed and Delivered On the Back of the aforegoing Deed was thus Endorst (Viz.t) in Presence of On the Tenth Day of February Anno Domini Seventeen hundred Ja Calder Forty Three Philemon Church within named Appeared before James Nicols the Subscribers Two of his Lordship's Justices of the Peace for Recorded April 11.th 1744 Kent County And acknowledged the within Written Instrument of Bargain and Sale to be his Act and Deed to and for the Uses Intents & Purposes within mentioned Ch.s Hynson 6 B Hands Ex.d This Indenture Made this Eleventh Day of February in the Year of our Lord Christ One Thousand Seven Hundred ^Forty^ & Forty Three Between Philemon Church of Kent County and Province of Maryland Planter of the First Part Gideon Pearce of the same County and Province Gentleman of the Second Part and Samuel Groom of the same County and Province Gentleman of the Third part Witnesseth that as well for Docking and barring all Estates Tail Reversions Remainders and all other the Estate or Estates Terms and Interests heretofore Limitted [illegible] ^Created^ or declared of for or Concerning all that Tract or Parcell of Land Lying and being in Kent County afores.d called The Exchange and commonly Deemed and Reputed to be part of a Tract of Land Called Cornwellis's Choice with the Appurtenances hereafter Granted or intended to be Granted and for Settling and Assuring the same to the uses intents and Purposes hereafter mentioned as for and in Consideration of Five Shillings Current Money of Maryland to him the said Philemon in Hand paid by the same Samuel before the Sealing & delivery of these presents the Receipt whereof is hereby Acknowledged and for diverse other gentle Causes and Considerations him the same Philemon hereunto Moving He the s.d Philemon Hath Granted Bargained Released and Confirmed And by these Presents Doth Grant Bargain Release and Confirm unto the same Samuel (in his Actual Possession now being by Virtue of a Bargain and Sale to him made for One Year by Indenture bearing Date the Day next before the Date hereof and of the Statute made for Transferring uses into Possessions) All the afores.d Tract or Parcell of Land lying and being in Kent County af.d and Called as af.d Beginning at a leaning Chesnut Oak Standing by the side of a Little Cove and Runing from the said Tree East Cross the said Cove and into the Woods One Hundred and Twenty Perches Bounding on the End of the said East Line and Runing along North until it intersect a West Line of a Parcell of Land formerly in the Possession of a Certain Robert Gibson One Hundred and Thirteen Perches, Bounded on the said Intersection and Runing (along) |
