       Adm.rs or Assigns do and shall well and truly pay or Cause to be paid unto
       the said James Russell and James Wardrop their Executors Administrators
       or Assigns on the first day of September which shall be in the Year of our
       Lord one Thousand seven hundred and forty four the sum of Two hundred
       and thirty one pounds Ten shillings sterling with legall Interest for the
       same from the Date hereof that then and from thenceforth this Present
       Indenture and the Gift Bargain and sale aforesaid of the part of the
       Tract of Land aforesaid and premisses aforesaid with the appurtenances
       shall be Clearly and utterly void and frustrate as though the same
       had never been made and the said Thomas Brooke jun.r Doth for himself
       hiss heirs Executors and Adm.rs further Covenant promise grant and agree
       to and with the said James Russelll and James Wardrop their heirs
       Executors Administrators and Assigns that if the said Thomas
       Brooke Jun.r his heirs Executors Administrators or Assigns shall
       make Default and shall not pay the said sum of Two hundred and
       thirty one pounds Ten shillings sterling as aforesaid with Legal Interest
       thereon accruing and every part thereof to the said James Russell and
       James Wardrop their Executors Adm.rs and Assigns in manner &
       form as afs.d that then from time and at all times after
       such Default made the said Thomas Brooke Junior his heirs
       or assigns upon Reasonable request shall and will Yield up
       & Deliver all the said part of the Tract or parcel of Land and
       Premisses afs.d with the appurtenances into the hands and
       Possession of the said James Russell and James Wardrop their
       heirs and Assigns freed and discharged of the Proviso Condition
       and agreement abovementioned and of all Power and benefit of Redemption
       by such assurance and Conveyance in the Law as by the said James
       Russell and James Wardrop their heirs or assigns or either of their shall
       be Required In Testimony whereof the Person first above mentioned
       hath to these Presents put his hand and affixed his seal the Day and
       Year first above written                                       Tho.s Brooke jun.r   Seal
            Signed Sealed & Delivered
             In Presence of                              On the Back of the aforegoing
