451) aforesaid Called Brookfield bounded as follows Viz.t all that Part of the said Tract which Lyes to the south and east of the Branch commonly called the Long Bridge Branch and bounded with the said Branch the Lands sold Daniel Dulany Esq.r and Alexander Contee the Land formerly in Possession of Cap.t Clement Brooke and the Glebe Land Together with all and singular the Houses and other improvements Conveniencys and Advantages on the said Land belonging or in any manner appertaining To have and to hold the said part of the Tract of Land called Brookefield & Premisses aforesaid with the Appurtenances unto the said James Russell and James Wardrop their heirs & Assigns for ever to the only proper use and behoof of them the said James Russell and James Wardrop their heirs and Assigns and to no other use intent or purpose whatsoever and the said Thomas Brooke Junior doth for himself his heirs Executors Administrators and Assigns Covenant Promise grant and agree to and with the said James Russell and James Wardrop their heirs and Assigns that he the said Thomas Brooke junior now is the True and sole owner of the afs.d part of the Tract of Land Called Brookefield afs.d and Premisses afs.d with the appurtenances and that he the said Thomas Brooke Jun.r hath Lawfull Right and Authority to give grant Bargain and sell the same according to the Tenor of these presents and that the said Part of the Tract or parcel of Land Called Brookefield and Premisses with the appurtenances shall stand and abide Clear and free Discharged and acquitted or otherwise by the said Thomas Brooke junior sufficiently saved harmless of and from all and Singular former Bargains Gifts grants and Sales had made done procured or suffered by the said Thomas Brooke Jun.r or by his Consent or Procurement and further the said Thomas Brooke jun.r doth for himself his heirs Executors and Adm.rs Covenant Promise grant and agree to and with the said James Russell and James Wardrop their heirs and Assigns with the said Thomas Brooke jun.r and his heirs the part of the Tract of Land called Brookefield and Premisses aforesaid with the appurtenances unto the said James Russell and James Wardrop their heirs and Assigns against all person and persons Whatsoever shall and will for ever hereafter well and Truly warrant and for ever Defend by these Presents Provided Nevertheless and it is agreed by and between all and every the parties to these presents That if the said Thomas Brooke Jun.r his heirs Ex.rs (adm.rs) |
