       Discharged & acquitted or otherwise by the said John Hillary sufficiently
       saved harmless of & from all & singular former Bargains Gifts Grants
       & Sales had made Done procured or suffered by the said John Hillary
       or by his Consent or Procurement Provided Nevertheless & it is
       Agreed by & between all & every the Parties to these Presents that
       if the said John Hillary his Heirs Executors Administrators or
       Assignes do & shall well & truly pay or Cause to be paid unto the
       said James Russell & James Wardrop their Exors Adm.rs or Assigns on
       the twenty fifth Day of September which shall be in the Year of
       our Lord One thousand Seven hundred & forty five the Sum of
       four hundred pounds Current Money of Maryland af.d with the
       Legall Interest for the same from the Date hereof that then & from
       thenceforth this Present Indenture & the Gift Bargain & sale af.d of
       all & Singular the Land & Premisses af.d & the Negroes af.d shall be
       clearly & Utterly void & frustrate as though the same had never
       been Made And the said John Hillary doth for himself his Heirs
       Exors & Admors further Covenant promise Grant & Agree to & with
       the said James Russell & James Wardrop their Heirs Exors Admors
       & Assigns That if the said John Hillary his Heirs Exors Admors
       or Assigns shall make Default & shall not pay the said Sum of four
       Hundred pounds Current Money af.d with Legal Interest thereon
       accruing & every Part thereof to the said James Russell & James
       Wardrop their Exors Admors or Assigns in Manner & form afd
       that then from time to time & at all times after such Default
       made the said John Hillary his Heirs Exors Admors or Assigns
       upon reasonable request shall & will yeild up & Deliver all the
       said Tract or Parcell of Land & Premisses af.d & the Negroes af.d unto
       the hands & Possession of the said James Russell & James Wardrop
       their Heirs Exors Admors or Assignes freed & Discharged of the
       Proviso Condition & Agreement ^above mentioned^ & of all Power & benefit of Redemption
       by Such Assurance & Conveyance in the Law as by
       the said James Russell & James Wardrop their Exors Admors or
       Assignes or either of them shall be required And as part of the
