438) several Lands and Tenements with their and every of their appurts to the said John Philpot and Edward Lee their Heirs and Assigns will warr.t and defend and also that he the said Thomas Sligh the several Servants Slaves Goods Chattles and Tobaccos herein before expressed to the said John Philpot and Edw.d Lee their Ex.rs Adm.rs and Assigns against all Persons and Claims whatsoever will Warrant and defend Provided always and it is the true intent and meaning of these Presents that if the said Thomas Sligh shall well and truly pay unto the said John Philpot and Edw.d Lee their Certain Attorney Ex.rs Adm.rs or assigns at the Publick Court house in Annapolis on the Twenty first day of September which shall be in the Year of our Lord one Thousand seven hundred and Forty four the sum of Three hundred eighteen pounds sixteen Shillings and five pence sterling with the lawfull Interest thereof from the sixteenth day of May last the like sum of three hundred eighteen pounds sixteen shillings and five pence with the like Interest at the same Court house on or before the Twenty first day of September one Thousand seven hundred and forty five, the like sum of three hundred eighteen pounds sixteen shillings and five pence sterling with the like interest at the same Place on or before the twenty first day of Sep.t one Thousand seven hundred and forty six and ^the^ full sum of three hundred sixteen pounds eighteen shillings and four pence sterling with the like Interest and at the same place on or before the Twenty first Day of Sep.t in the Year one Thousand seven hundred & forty seven, then these Presents and every part and Article thereof shall be Void and of non effect And that the said Thomas Sligh shall Stand and be seized of his former Estate of and in the several Lands and Tenements afs.d with their and every of their appurtenances and also Possessed of the said Sarvants Slaves Goods and Chattles as of his former Right And the said Thomas Sligh Doth Covenant Grant and agree for himself and his heirs to and with the said John Philpot and Edw.d Lee their Exors Admors and Assigns that the several sums of money afs.d with the Legal Interest thereof shall be well and truly paid according to the true Intent and meaning of these Presents And is it hereby Covenanted and agreed by and between the said Parties that it shall and may be lawfull for the sid Thomas Sligh to sell and Convey any of the Tracts of Land herein before mentioned or any of the said Servants Slaves Goods or Chattles for sterling Money to the best Advantage and Highest bidder so always as the Agent or Attorney in fact of the said John Philpot and Edw.d Lee have due and timely Notice of such Sale Ten days at (the) |
