38) of these Presents is Seized of and Absolute & Indefeazible Estate of Inheritance of in & to the Said Premisses in fee Simple without any Condition Limitation or Other matter or thing whatsoever in any other Person or Persons whatsoever to Alter Change Charge Determine or Defeat the Same Estate And also that he the Said Archibald Greenfield now hath Good Right full Power & Lawfull & Absolute Authority to Grant & Sell the af.d Premisses with the Appurtenances unto the Said Patrick Kennedy his heirs & Assigns in Manner & forme af.d And that if Default be made in the Payment of the money herein Covenant to be Paid or Any Part thereof that then & from thence forth it Shall & may be Lawfull to and for the Said Patrick Kennedy his heirs or assigns to Enter into all & Singular the Premisses hereby Granted & Sold & the Same Peaceably & Quietly to have Hold & Enjoy without any manner of Lett Suit Trouble or Interruption whatsoever & that free & Clear of & from all Other & former & Other Gifts Grants or Mortgages whatsoever In Witness whereof the said Archibald Greenfield hath hereunto Set his hand & Seale the Day & year first Above Written Archibald Greenfield seale On the Back of the foregoing Deed was thus Endorst Viz.t Signed Sealed & Delivered Edward Smith James Barnes May the 17.th 1738 Then Came before me the Subscriber One of his Lordships Justices of Provincial the w.thin Named Archibald Greenfield & Acknowledged w.thin Deed of Mortgage to be his Act & Deed & the Land & P.rses therein mentioned to be the Estate Right & Title of the within Named Patrick Kennedy his heirs & Assigns According to the true Intent & Meaning of the said within Written Deed Recorded May y.e Eighteenth 1738 Robert Gordon 9 1/2 |
