29) have hold occupy possess & Enjoy all & Singular the Premisses without any Lett Hinderance Disturbance or Interruption of them the said Francis Hall & Dorothy his Wife or Either of them their or Either of their Heirs or any other Person or Persons whatsoever Claiming from by or under them or Either of them or from by or under any of the other Sisters ^or Coheirs^ of the said Nicholas Lowe or any of them or their or any of their Heirs And the said Francis Hall for himself & Dorothy his Wife & their Heirs further Covenant & Agree to & with the said James Paul Heath his Heirs & Assignes that they the said Francis & Dorothy his Wife or their Heirs shall at any time within Ten Years from the Date of these Presents at the request ^and^ Proper Cost & Charge of the said James Paul Heath make & Execute any further or other instrument Deed or Conveyance for the better Assurance of the promisses to the said James Paul Heath his Heirs or Assignes which shall be devised advised or required by the said James Paul Heath his heirs or Assignes so as such further Assurance Contain no other or further Warranty than these presents And Lastly the said Francis Hall for himself and his Heirs doth Covenant & agree to & with the said James Paul Heath his Heirs & Assignes that he the said Francis Hall will procure a firm Deed of Conveyance from Henry Darnall of Portland Mannor Gentleman & Elizabeth his Wife one of the Sisters of the said Nicholas Lowe William Digges Jun.r Heir at Law of Susanna Digges one other of the Sisters of the said Nicholas Lowe & Mary & Elianor Neale Daughters of Edward Neale of Charles County Gentleman & Dorothy his late Wife one other of the SIsters of the said Nicholas Lowe of all their severall & respective Rights of in & to the said Part or Parcell of the said Tract Called Mount Herman or Hermans Mount herein before mentioned & Described to the said James Paul Heath his Heirs & Assignes for Ever In Witness whereof the said Francis Hall & Dorothy his Wife have hereunto set their hands & seals the Day & Year first above Written Sealed & Delivered Francis Hall Seal in the presence of her Jn.o Hepburn Dorothy D Hall Seal John Sprigg Mark Tho.s Addison On the back of the aforegoing Deed was thus Endorst vizt Jan.ry the 14.th 1737 I acknowledge to have reced from M.r James Paul Heath fifteen pounds Sterling being the £ 15 Consideration Money within mentioned Test Jn.o Addison Francis Hall Tho.s Addison Jan.ry 11.th 1737 The within named Francis Hall & Dorothy his Wife Partys to the within Deed acknowledged the same according to the Directions of the Act of Assembly in such Cases Provided And the said Dorothy being Examined privately & a part from her said Husband Declared that she became a Party to the within Deed (Executed) |
