28) Robert Kendrick his Heirs and Assignes for Ever according to the true intent and Meaning of the within Deed of Bargain and Sale 11 Sides Recorded Dec.r 31.st 1737 Robert Gordon Ex.d This Indenture made the fourteenth Day of January in the Year of our Lord One thousand seven hundred & thirty seven Between Francis Hall of Prince Georges County Gentleman and Dorothy his Wife one of the sisters & Coheirs of Nicholas Lowe late of S.t Marys County \ Esq.r deceased of the one part and James Paul Heath of Cecil County Gentleman of the other Part Whereas the Lands & Tenements whereof the said Nicholas Lowe deced died seized descended unto the said Dorothy Wife of the said Francis Hall party to these Presents & others the Sisters of the said Nicholas Lowe & their Heirs as Coparceners Which Lands & Tenements were divided among the said Sisters & their Heirs And that all the Right Claim & Demand of the said Nicholas Lowe of in & to ^part or parcell of^ a Tract of Land in Cecil County lieing on Sasafras River Called Mount Herman or Hermans Mouth hereinafter described was included in the Purpart or Share of the said Francis Hall & Dorothy his Wife Now this Indenture witnesseth that the said Francis Hall & Dorothy his Wife for & in Consideration of fifteen pounds Sterling by the said James Paul Heath to the said Francis Hall in hand paid before the Ensealing and Deliver of these presents the Receipt whereof is hereby acknowledged & the said James Paul Heath thereof & of Every Part and Parcell thereof fully acquitted Exonerated & Discharged have given Granted bargained and sold all the right title interest Claim and Demand of them the said Francis hall and Dorothy his Wife of in & to all that part or parcell of the Tract of said Land lieing on Sasafras River in the County of Cecil called Mount Herman or Herman Mount here tofore in the Tenure or Occupation of William Ward & now being in tenure & occupation of the said James Paul Heath lying on the North side of a Creek Called Back Creek & Beginning at the Mouth of a small branch Called Axells branch or Creek & running for length into the Woods North North East three hundred & twenty perches bound on the West & North by the said line on the East by Hermans branch & on the South by Sasafras River which is supposed will Cont One hundred & fifty six acres Whether the same shall or doth Contain more or less or whatsoever Quantity of Land the same bounds & lines Contain with all profits improvements and Appurtenances therein belonging To have and to hold to him the said James Paul Heath his Heirs & Assignes for Ever to his & their own use & no ^none^ other And the said Francis Hall for himself & Dorothy his Wife & their Heirs doth Covenant Grant & agree to & with the said James Paul Heath his Heirs & Assignes that eh & they shall & may for ever hereafter (have) |
