133) Now This Indenture Witneseeth that In Consideration of & for Securing the Repayment to the said Conradt De Smith & George Heathcoate of Such Sum or Sumes of Money as they the said Conradt De Smith and George Heathcoate or Either of them shall Pay or Cause to be Paid for or on Accou^n^t of the aforesaid Bills of Exchange or any of them he the said Jacob Holland Hath Granted Bargained & Sold and by these Presents Doth Grant Bargain and Sell unto the Said Conradt De Smith & George Heathcoate their Heirs & Assigns all that one hundred acres of Land Part of a Tract of Land Called Hollands Choice Devised to him by the Testament and last will of his late Father Anthony Holland Deceased Also all that one hundred acres of Land being another Part of the said Tract Called Hollands Choice Devised by the said Testament & Last will to Elizabeth Gott Also all His Share Part Right Title and Interest ^in &^ to One hundred Acres being another Part of the said Hollands Choice Devised to his late Brother Richard Holland Deceased who Dyed without Issue together with all and Singular the Houses out houses and Appurtenances to the aforesaid Premisses or any of them belonging To Have and to Hold the same unto the said Conradt De Smith and George Heathcoate their Heirs and Assigns for ever And this Indenture further Witnesseth that for the Consideration & Purposes aforesaid he the said Jacob Holland Hath Given Sold Assigned Transferred & Set over and by these Presents Doth give Sell assign Transfer and Set over unto the said Conradt De Smith and George Heathcoate their Executors Administrators & Assigns Two Negroes now in the Possession of the Said Jacob Holland Viz.t a Negro Man Called Sampson & a Negroe Woman Called Anne with their Increase To Have take receive Possess and and hold the same Negroes and Each of them to and for the Proper use ^Benefit^ and behoofe of the said Conradt De Smith & George Heathcoate their Executors Administrators and Assigns Provided Nevertheless That Either in Case the said Jacob Holland and Executors Administrators or Assigns Shall Pay or Cause to Paid on or before the Fifth Day of December which shall be in the year of our Lord Seventeen hundred and forty one to the said Conradt De Smith & George Heathcoate their Executors Administrators & Assigns all & every Such Sume & Sumes of Money as the said Conradt De Smith and George Heathcoat or Either of them Shall Pay or Cause to be Paid for or on Account of the said Bills of Exchange or any or in Case y.e said Conradt de Smith or Geo Heathcoat or either of them shall not accept & Pay or cause to be paid any of y.e said Bills of Exchange then & in Either of y.e af.d Cases it (is) |
