134 is the True Intent and Meaning of these Presents and the Partys thereto that this Present Deed and Indenture and Every Clause herein shall be void Frustrate and of no Effect to all Intents and Purposes And the said Jacob Holland Doth for himself his Heirs Executors Administrators and Assigns Covenant Promise Grant and Agree to & with the said Conradt De Smith and George Heathcoat their Executors Administrators and Assigns that he the said Jacob Holland his Executors Administrators and Assigns shall and will Pay & Cause to be paid on or before the said fifth Day of December to the said Conradt De Smith and George Heathcoat their Executors Administrator and Assigns all and every Such Sum and Sums of Money as they the Said Conradt De Smith & George Heathcoat or Either of them shall Pay or Cause to be Paid on Account of the said Bills or any of them And Lastly the said Jacob Holland for himself his Heirs Executors Administrators & Assigns Doth Covenant Promise Grant and Agree to and with the said Conradt De Smith & George Heathco^a^t their Heirs Executors Administrators and Assigns the aforesaid Bargained Sold and Transferred Premisses and every Part and Parcell thereof to the said Conradt De Smith & George Heathcoat their Heirs Executors Administrators and Assigns against all and Every Person & Persons Whatsoever shall and will Warrant and for ever Defend In Witness whereof the Said Jacob ^Holland^ Hath hereunto Set his hand & affixed his Seal the Day & year abovementioned Jacob Holland seal On the Back of the aforegoing Deed was thus Indorst Viz.t Signed Sealed & Delivered in the Presence of us W.m Rogers Nicho Maccubbin December the 5.th 1739 Then Came before us the Subscribers two of his Lordships Justices of the Peace for Ann Arundell County the within Named Jacob Holland and acknowledged the within Deed of Mortgage to be his Act and Deed and the Lands & Premisses & Slaves therein Mentioned to be the Estate Right and Title of them the said Conradt De Smith & George Heathcoat their Heirs and Assignes according to the form of the Act of Assembly 8 sides in Such Cases Provided W.m Rogers Recorded June the 4.th 1740 Nicho Maccubbin |
