(549) Ex.d This Indenture made the thirtyeth Day of September Anno Domini One Cash p.d thousand seven hundred & thirty Six Between Elizabeth Gin of the City of London Vidow in her Own right & William Woodward of the same Place Goldsmith & Mary Holmes of Newington Butts in the County of Surrey Widow Executors Trustees and Divisees of the Testament & Last Will of Mary Woodward late of Newington Butts af.d Widow Deceased of the one Part And John Gray Son of John Gray of Ann.ll C.ty Planter of the Other Part Whereas Henry Maynard on the twelfth Day of February Seventeen hundred & eleven by his Deed of Bargain & Sale Duely Executed Acknowledged & Recorded for the Consideration therein mentioned Did Grant Bargain Sell Alien Enfeoffe & Confirm unto Amos Garrett late of the City of Annapolis in the Province of Maryland Merchant Deceased his heirs and Assigns all that Tract or Parcell of Land Called Sturtons Rest Containing and laid Out for One hundred & ten Acres of Land more or Less lying & being in Ann.ll County aforesaid And Whereas the said Amos Garrett being so Seized of & Intituled to the said Tract of Land called Sturtons Rest as af.d Dyed Intestate after whose Death all his Real Estate Desended to & Vested in the said Mary Woodward and Elizabeth Gin his two Surviving Sisters as Parconers or Tenants in Common And Whereas the Said Mary Woodward is Since the Death of the sid Amos Garrett also Dead but before her Death made her Testament and Last Will Duely Proved & by the Same Testament & Last Will Gave and Devised unto the beforementioned William Woodward & Mary Holmes Parties to these Presents their heirs & Assignes all her Undivided Moiety of the said Real Estate whether Houses Land Plantations Messuages Tenements or other Hereditaments & also all other the real Estate of what Nature or kind soever Which She the Said Mary Woodward Should be Seized of or Intitled to at the time of her Death in Maryland af.d or Else where Upon the trust & to the Intent & Purpose that they the said William Woodward & Mary Holmes or the Survivor of them or the heirs of Such Survivor Should as Soon as Conveniently might be Join with the said Eliz.a Gin in the Sale of the said Real Estate in Maryland or in Case of her Death that they the s.d William Woodward & Mary Holmes or the Survivor of them or the heirs of Such Survivor Should by himself herself or themselves make Sale of the Said Real Estate for the best price that Could reasonably be had or Obtained for the Same which moneys so to be Raised by such Sale were Directed by the said Last Will & Testament to be Divided amongst the Persons mentioned in Such Will for that Purpose as by the Same Last Will & Testament Relation being thereunto had may (More) |
