(52) thereof and therefrom and of and from every part thereof Doth Exonerate Release and Acquitt Hath Bargained and Sold and by these Presents doth Bargain & sell unto the said Charles Carroll all the severall Tracts of Land aforesaid with the appurtenances and all the Goods and Chattles aforesaid except the Negroe Man in the said Recited Deed Mencond To have and to hold all the said Tracts of Land with the appurtenances to him the said Charles Carroll his heirs and assignes for ever to his and their own use and none other & the Goods and Chattles except as before excepted to him the said Charles Carroll his executors administrators or assignes to his and their own use and none other And the said William Chapman for and on Behalf of the said Phillip Smith Doth Covenant and Agree & Agree that the said Land and Chattles except as before excepted are clear from any incumberance whatsoever for or by reason of any Act or Acts done by the said Phillip Smith or any other person by his Directions means or procurement and that the said Charles Carroll his heirs executors administrators or assignes shall and may have hold possess and enjoy the said Lands and Chattles except as before excepted to his and their own use for ever without any Lett Molestation Disturbance or Interruption from the said Phillip Smith or any other person claiming from by or under him And Lastly that the Said Philip Smith shall and will at any time within three years at the proper Cost and Charge of the Said Charles Carroll his heirs or assignes make and duley execute any further or other Conveyance for the Better assurance and Confirmation of the Premisses except as before excepted that shall be reasonably advised Devised or Required by the said Charles Carroll his heirs or assignes or his or their Councill Learned in the Law so as such further Conveyance shall Contain no other than a special Warr.ty In Witness whereof the said William Chapman hath hereunto set his hand and seale the day and year first above written Sealed and Delivered W.m Chapman seale in the presence of us D Dulany Zach Maccubbin On the Back of the aforegoing indenture was thus Endorst vizt Received the sume of one hundred thirty pounds sterling the Consideration within Mencond Witness D Dulany W.m Chapman Zach Maccubbin (Maryland) |
