(49) Will for and in Consideration of Forty Nine pounds Strerling to them in hand paid by the said Daniel Dulany the receipt whereof they hereby acknowledge and him the said Daniel Dulany thereof and of every part thereof Do exonerate acquit and Discharge Have Bargained and Sold And by these presents Do Bargain and sell unto Daniel Dulany all the right title intrest claim and Demand whatsoever & w.ch he the said James Carroll in his Life time ever had to y.e said Land Together with all Buildings Improvements proffitts Commodities advantages and appurtenances whatsoever thereunto or unto any part thereof belonging or appertaining together with all Grants Deeds and Evidences thereunto Relateing To have and To hold to him the said Daniel Dulany his Heirs and Assignes to his and their own use and Behoof and to no other use or purpose whatsoever And the said Charles Carroll Doctor Charles Carroll & John Digges for themselves and their heirs Covenant promise and agree to and with the said Daniel Dulany his Heirs and assignes that he and they shall and may peaceably have hold possess and enjoy for ever hereafter all and singular the premisses without any Lett Disturbance or molestation of them the said Charles Carroll Doct.r Charles Carroll and John Digges or any of them or any person whatsoever Claiming from by or under him the Said James Carroll or his heirs and all persons whatsoever having the estate of him the said James Carroll And that they the said Charles ^Carroll^ Doctor Charles Carroll and John Digges the said Land and Premisses to the said Daniel Dulany his Heirs and assignes for ever will Warrant and Defend against all Persons whatsoever claiming from by or under them or any of them or any of them or from by or under any person claiming or Deriveing any right title or interest in or to the Premisses or any part thereof as heir at Law of the said James Carroll or any Right title interest or Demand as Derived from the said James Carroll by any way or Means Whatsoever And the said Charles Carroll Docter Charles Carroll and John Digges Doe further Covenant and Agree to and with the said Daniel Dulany that they the said Charles Carroll Docter Charles Carroll and John Digges shall & will at any time within the Space of seven years from the Date hereof at the reasonable request and proper Cost and Charge of the Said Daniel Dulany his heirs or assignes make Doe execute or suffer any further or other Act (or) |
