(37) Doth Covenant Promise and Grant to and with the Other
of the said parties to these presents for himselfe his heirs executors and administrators in manner & forme following (that is to say) That Either of them the said parties to these presents and the Heirs & assignes of Either of them respectively shall & may from time to time and at all times hereafter have receive take and Enjoy an Equall Share Benefitt profitt and advantage of the said Mannor Lands Hereditaments & Premisses with the Appurtenances And that Neither of the Said Parties to these Presents nor the Heirs or assignes of Either of them shall take any Advantage for or by reason of Survivorship but that the party surviveing his heirs and assignes shall and will upon reasonable request convey and assure to the heirs or assignes of the party first deceasing or to such other person or persons as he by his Last Will and Testament or Otherwise in Writeing shall Limitt and appoint one full and Equall Moeity or half part of all and Singular the Said Mannor Lands Hereditaments and Premisses aforesaid with the appurtenances by such ways and meanes as by Councill Learned in the Law shall be reasonably advised And Lastly that Either of the said parties to these Presents his Heirs and Assignes shall and will Bear pay and discharge an Equall Share of all Moneys as shall be Expended for reparations Buildings and Improvements on the Said Premisses and of all Quitt Rents Taxes and Other Charges Incident to or Charged upon the Same In Witness whereof the Said parties to these Present Articles of Agreement Indented Interchangeably have Sett their hands and Seales the Day and year first above Written William Stavely seale Sealed and Delivered being first duly Stamp.t in the presence of us Cha Carroll John James Thomas Hopkins Scr Richard Roycroft at the 3 Tunn Tavern in Cornhill On the Back of the af.d Articles of Agreement was thus Endorst vizt (October) |
