(263) x.d This Indenture made the second day of february Anno Dom one thousand seven hundred & thirty three four Between Hezekiah Clarke of Ann Arrundell County in the Province of Maryland planter Executor of the last will & testam.t of his Brother Thomas Clarke planter Late of the s.d County & province Deceased of the one part And Richard Snowden of the s.d County & province Merchant of the other part Witnesseth that Whereas the afd Thomas Clarke Deceased did By his Last Will & Testament order & Impower his Executor the said Hezekiah Clarke to sell four hundred Acres of Land hereinafter Mentioned in order to Raise Money towards the discharging & paying the debts the Debts of the said Thomas therefore the said Hezekiah Clarke according to the trust & power given unto him by the said Will for and in Consideration of the sume of tenn pounds pounds Currant money to him hand paid at & before the Insealing & delivery hereof by Richard Snowden as aforesaid the Receipt Whereof he doth ^hereby^ acknowledge & thereof & of every part thereof Doth Acquit Exonerate & Discharge the said Richard Snowden his Heirs & assigns for ever hath given granted Bargained sold assigned aliened enfeoffed transferred & Confirmed And by these presents Doth give grant bargain & sell assinge aliene enfeoffe transferr & Confirm unto the said Richard Snowden his heirs & assigns for ever all those two peices or parcells of Land Late in the possession of said Thomas Clarke the ^one^ Called Bazills Beginning Lying & being in Ann Arrundell County Aforesaid And one ^thy^ falls of that part of Patuxant River Called Snowdens River and Containeth by Computation two hundred Acres be the same more or less the other peice or pacell of Land being part of two tracts Called Clarkes Groves & the Addition to Clarkes Groves Lying & being in Prince Georges County in the province afd & on Snowdens River aforesaid near a Swamp Called the Great Swamp Which Last parcell of Land hereby intended to be Granted & sold being all the Residue & Remainder of those two tracts of Land aforesaid called Clarks Groves & the Addition to Clarks Groves Left unsold or otherwise undisposed of by the aforesaid Thomas Clark & Containeth by Estimation two hundred Acres of Land be the same More or less to with all Buildings fences timber trees Woods Undewoods priviledges propertys Commodites & Appurtenances Whatsoever on the afd four hundred ^Acres of^ Land or any part thereof being or to the same or to any part or parcell thereof belonging or in any wise Appertaining And all the Estate Right Title Equity interest Claime & Demand Whatsoever of him the s.d Hezekiah Clark by Virtue of the Will of his Brother Thomas aforesaid or by any |
