(121) x.d To all persons to whom these Indented Presents shall come I Philip Smith Merchant in London sendeth Greeting Know Ye that Whereas Thomas Taylor of Baltimore County in the Province of Maryland Planter by Deed of Bargain and Sale Duely Executed & Enrolled Amongst the Land Records of the sid County bearing Date the Nineteenth Day of May in the Year of our Lord Seventeen hundred and twenty four Bargained Sold Conveyed and made over unto me the said Philip Smith several Lands and Chattles in the said Deed Mentioned for the Consideration therein Expressed subject to Redemption upon the payment of several sums of Money upon the Days and times in the said Deed Specified which Sums or any of them were not paid by the said Thomas Taylor And Whereas William Chapman Merchant in Ann Arundell County in the said Province as my Attorney in fact by Virtue of a power of attorney from me the said Philip Smith for the Consideration of one hundred and Thirty pounds Sterling to him for my uses paid by Charles Carroll of the City of Annapolis in the said Province Esq.r by Deed of Bargain and Sale Duely Executed Sold and Conveyed all my Right Title Interest Claim & Demand of in and to the said Lands and Chattles One Negro Man Excepted unto the s.d Charles Carroll his heirs Executors Administrators or Assigns in Consideration whereof and the further Sum of five Shillings Sterling to me in hand paid by the said Charles Carroll the Receipt whereof I hereby acknowledge and the said Charles thereof and therefrom Doth Exonerate and Discharge I the said Philip Smith have remised released and Quited Claim and by these Presents for my self my Heirs Executors and Administrators doth fully clearly and Absolutely Remise Release and Quit Claim unto the said Charles Carroll (in his possession being) the said Lands and Chattles (the said Negroe Man Excepted) to have and to hold the said Lands and Chattels (Except as before Excepted) to him the said Charles Carroll his heirs Executors Administrators or Assigns for ever to his and their own use and behoofe and to none other Use or Purpose so that Neither I the said Philip Smith my heirs Executors Administrators or any other Person or Persons Whatsoever Claiming from by or under me or them shall have Claim or demand any Right Title or Interest in the said Lands or Chattels (Except as before Excepted) and I the said Philip Smith and my heirs Executors or and Administrators the said Lands and Chattels (Except as before Excepted) to the said Charles Carroll his Heirs Executors Administrators or Assigns against me my heirs Executors ^and^ Administrators and all other Persons Claiming from by or under me or them will Warrant and for Ever defend In |
