112 thereof To have and to hold all the said Tract and Parcel of Land and Premisses aforesaid with the appurtenances unto him the said John Contee his heirs and Assigns for Ever and the said Benony Fanning and Hannah his wife for them selves their heirs Executors & Administrators doth hereby Promise Covenant and Agree to and with the said John Contee his heirs Executors & Adm.rs and every of them by these presents that he the said Benony Fanning at the time of the Ensealing and Delivery of these presents is Siezed in his Demesne as of fee of and in the above Mentioned to be bargained Premisses with the Appurtenances of a Good and sure Indefeazable Estate of Inheritance in fee simple free and Discharged of all incumbrances whatsoever and is the true and perfect owner of the said hereby bargained premisses with the appurtenances and hath in him full power good Right and lawful interest & authority to Grant Bargain Sell and Assign over the same Premisses unto the said John Contee his heirs and assigns for ever in Manner and form aforesaid and that he the said Benony Fanning and his heirs the same above bargained premisses with the appurtenances unto the said John Contee his heirs and assigns shall and will Warrant and for ever defend by these presents In Witness whereof the parties above Mentioned to these present indenture have hereunto set their hands and Seals the Day and Year first above written Signed Sealed & Delivered his In the Presence of Benony M Fanning seal mark Philip Lynes Jn.o Warren her Hannah X Fanning seal mark Memorand.m on the Back of the foregoing Deed of Sale was thus Written Viz.t Charles County fs.t Memorandum that Benony Fanning and Hannah his wife the within Menconed parties Came this Thirtyeth Day of April One Thousand Seven hundred and Eight and Did acknowledge the within Ceonveyance as the Law Requires she the said Hannah the wife of him the said Benony Fanning being first by me secretly Examined whether she was free & willing to acknowledge and freely Resign her Right to the said Land and that she doth not do the same by Means of any Threats or fear of her husband and the said Hannah and the said Hannah doth Declare that she doth not but of her own will and free Consent she doth the same And is acknowledged according to Law by the said Benony and Hannah before me One of her Majestys (Justices) |
