(359) Three Degrees East forty five perches then East
Fifteen Degrees North fifty perches to an Old Bound white oak standing On the north side of the Main Branch of S.t Nicholas Creek then North forty five Degrees West fifty perches then North eighteen Degrees West forty seven perches then North six Degrees West Fifty five perches then North Forty five Degrees East Forty perches then East fifteen Degrees North One hundred Forty & Eight perches then North Fifty five Degrees East Thirty two perches to a Ceeder standing on a point by Fransham Creek side thence Down and with the said Creek South Eighteen Degrees East sixty perches then East Twenty Six Degrees South Two Hundred perches then with a straight Lyne to the first Bound Walnutt Tree Containing within the said Lines seven hundred Twenty and five Acres of Land Marsh and Water Bounded on the north with Fransham Creek and on the East with Patuxent River thereby takeing in the marsh thereto adjoyning To have and to hold The same and Every part and parcell thereof to him the said Richard Smith his heirs and assignes any Error Misprison Non Entry or Other Defects which might happen either by fault of surveyors or Clerks or for or by reason of any insufficiency irregularity or incongruity in any of the Warrants Certificates returnes of Certificates Methodes of the said Warrants untimeley Entrys of such Certificates or in any of the proceedings Towards obtaining this present Grants or patent in any Wise Notwithstanding the said Premisses hereby granted to be holden of us and our heirs as of our Manner of Calverton in Fee and Common soccage by Fealty only for all Manner of Services Yielding and Paying therefore yearly unto us and Our Heirs at our Receipt at y.e City of S.t Marys on the Two most usuall Feasts in the year Viz.t the Feast of the Annuntiation of the Blessed Virgian Mary and of S.t Mich.ll the Arch Angell by Even and Equall portions at the Rent of in the whole one pound nine shillings sterling in silver and ^or^ Gold * or the full Value thereof in such Comodities as wee and our heirs or such officer or officers as shall be appointed by us & our heirs from time to time to Collect and receive the same shall accept in Discharge thereof at the Choice of us & our heirs or such offic^e^r or officers as aforesaid Provided that if the said sume for a Fine for (Alienation) * the said seven hundred twenty five acres hereby Granted being taken up under our Condition of Plantations that Reserved four shillings p Annum for Every hundred Acres & for a fine upon Every Alienation of the said Land or any part or parcell thereof One Whole Years rent to be paid to us and our heirs in Silver or Gold |
