(146) To and with the said James Carroll his
heirs & assignes To Deliver unto the said James his heirs or assigns all Deed Writeings and parts whatsoever that any manner of way concerne the Lands and premisses afs.d and that such Deeds papers writeing and evidence shall demonstrate and shew The legall derivation of a good Indeafeazible Estate of Inheritance in fee simple as well from the Lord Baltemore as from all those thro whom The Estate to the whole or any parcell of the said Lands and premisses afs.d passed Provided nevertheless And it is the true intent & meaning of this Deed and the partys thereunto That if the said Bigger Head his Ex.rs or Adm.rs shall pay and satisfye unto the said James his Ex.rs Adm.rs or assigns at or upon the fourth day of January next The aforesaid sume of one hundred and six pounds sterling money of Great Brittain Then this Deed and every Clause and Article therein Contained to be null and void But upon fallure of the payment of the money afs.d at the times and in the manner whereof the partys to these presents have Interchangeably sett their hands & affixed their seals the day & year afs.d Signed Sealed & Delivered in the presence of And Hillman Bigger Head seale Tho.s Clark January the 3.d 1725 The reced of James Carroll one hundred and six pounds sterling being the Consideration money within mentioned as Wittness my hand the day and year aforesaid Test Farill Gallagher And Hillman Bigger Head Tho.s Clark January the 5 1725 Then came before me Samuell Young Esq.r Chief Justice of Maryland the within mentioned Bigger Head and acknowledged the within Deed according to Act of Assembly in that Case made and provided Sam.l Young Recorded 21.t May 8 sides 1726 |
